The Parliament validates decree-law 3/2026 on urgent education measures

The Plenary of the Parliament of the Balearic Islands validated Decree-law 3/2026, of August 7, establishing urgent measures in the field of education, in the session of September 9, 2026, following a debate and a total vote. The agreement is published in the Official Gazette of the Balearic Islands (BOIB) no. 116, of September 17, 2026, Section I. General Provisions, p. 50053, by means of Resolution 9179 (RGE no. 10894/26).

The validation is framed within article 49.2 of the Statute of Autonomy of the Balearic Islands and article 157.6 of the Parliamentary Regulations, which orders the publication of the agreement in the official gazette. The text, electronically signed on September 11, 2026, bears the signature of the President of the Parliament, Gabriel Le Senne Presedo. In the same session, Decree-law 2/2026, of August 7, on the protection of public health, was also validated by means of Resolution 9180 (RGE no. 10893/26).

Origin and scope of the regulation

Decree-law 3/2026 was approved by the Governing Council in the session of August 7, 2026, upon the proposal of the Minister of Education and Universities, Antoni Vera Alemany, and signed by the President, Margarita Prohens Rigo. It was published in BOIB no. 100, of August 11, 2026, p. 43742 (reference 8086).

The regulation is structured into two articles and, according to the statement of reasons, responds to the need for the legal framework to be in force before the start of the 2026-2027 academic year. Decree-laws are repealed if they are not validated by the Parliament within the non-extendable period of thirty days following promulgation.

Agreements for the first cycle of early childhood education

Article 1 modifies article 7 of Decree-law 5/2023, of August 28, on urgent measures in the educational and health fields. The main changes are:

  • Incorporation of teaching staff and early childhood education technicians into the delegated payroll payment system, or direct payment of the full module in the case of cooperative member staff, starting from January 2027.
  • Creation of the salary equalization supplement, payable from September 1, 2026, in a maximum of fourteen monthly payments and proportionally to the hours worked.
  • Annual justification of the amounts paid, with remaining funds allocated to guarantee the viability and quality of the service and with guarantees to avoid double funding.
  • Determination of the duration of the agreement according to Decree 21/2026, of July 31, regulating educational agreements.

The supplement is addressed to teachers and technicians included in the scope of the XIII Collective Agreement for childcare and early childhood education centers and the VII Collective Agreement for private education companies totally or partially supported by public funds, and is transitory until an eventual remuneration agreement is assumed by the Administration. The failure to formalize the modification of the agreement within the period set by the annual resolution will imply the termination of the agreement starting from the 2027-2028 academic year.

Health Sciences and agreement with the Health Service

Article 2 modifies Law 2/2003, of March 20, on the institutional organization of the university system of the Balearic Islands, with three new additional provisions:

  • Eighth: regime for professors with linked positions in health sciences studies, with a single payroll from the University of the Balearic Islands (UIB) and transfer of healthcare remuneration concepts from the Health Service of the Balearic Islands.
  • Ninth: participation of collaborating healthcare personnel in teaching activities, remunerated with the teaching collaboration supplement equivalent to the amount for associate professors.
  • Tenth: minimum content of the agreement between the Administration of the Autonomous Community, the Health Service, and the UIB, with a joint monitoring commission and institutional compensation mechanisms.

Deadlines and effects

The first final provision empowers the head of the department competent in education matters to issue the implementation rules, and the second final provision establishes the entry into force the day after publication in the bulletin. The sole repealing provision nullifies rules of equal or lower rank that oppose it.

With the validation, the Government of the Balearic Islands consolidates the regulatory framework with which it intends to organize the funding of agreements for the first cycle of early childhood education and the participation of healthcare professionals in university teaching. The measure directly affects subsidized centers, early childhood education teachers and technicians, families using this stage, and Health Service personnel who collaborate in health sciences studies.
