El IASS declara desierto el nuevo hogar de mayores de Huesca

The Aragonese Institute of Social Services (IASS) has declared the contract for the acquisition of the property intended to house a new elderly care home in the city of Huesca void, with a base tender budget of 2,037,400 euros, VAT included. The decision was adopted by the organization’s General Management via a resolution dated October 20, 2026, and published in the Official Gazette of Aragon number 214, dated November 5, 2026, in section V of announcements (official reference BOA20261105021). According to the technical report supporting the resolution, neither of the two offers submitted met the functional conditions required for an elderly care home.

The resolution concludes file IASS-GGD-2026-0006, a patrimonial contract—not subject to Law 9/2017, of November 8, on Public Sector Contracts, pursuant to article 9.2—which is governed by the consolidated text of the Aragon Heritage Law, approved by Legislative Decree 1/2023, of February 22. The file, the specifications governing the tender, and the resulting expenditure were approved by a resolution of the General Management on April 13, 2026, following a favorable report from the Minister of Finance, Interior and Public Administration, issued on December 29, 2025.

A four-month tender without a valid property

The tender announcement was published on April 30, 2026, on the contractor profile of the Public Sector Procurement Platform (PLACSP), in the Official Gazette of Aragon itself, on the IASS website, and on the notice board of the Huesca City Council. The deadline for submitting proposals ended on May 15, 2026, at 2:00 PM.

The procedure was resolved through public tender, with the award going to the most economically advantageous offer based on a plurality of criteria. Two candidacies were submitted:

  • Cáritas Diocesanas de Huesca.
  • María Josefa Betrán Gota, as a private bidder.

The Evaluation Commission, in a session on May 27, 2026, verified that both had participated in a timely and proper manner and agreed to request the correction of the detected deficiencies.

Sufficient surface area, unsuitable buildings

Once the documentation was submitted, the actions regarding compliance with requirements and the inspection of the properties were integrated into a single phase. On September 24, 2026, the technical architecture advisor of the IASS issued a report discarding both buildings, despite the fact that both met the useful surface area range set in the specifications:

  • The offer from Cáritas Diocesanas de Huesca presented inadequate access and space configuration, in addition to urban planning limitations that made adaptation to the program of needs “technically impossible.”
  • That of María Josefa Betrán Gota suffered from a space configuration and “insufficient natural ventilation and lighting” incompatible with the intended use.

In both cases, the report concludes that the properties do not meet the suitability conditions required under Decree 111/1992, of May 26, of the Diputación General de Aragón, which regulates the minimum conditions for specialized social services and establishments.

The Evaluation Commission unanimously accepted this report on September 28, 2026, and submitted to the competent body the proposal to declare the tender void, based on clause 13 of the specifications.

Accounting reversal and appeal process

The resolution not only declares the tender void: it also orders the decision to be notified to the interested parties and published in the Official Gazette of Aragón, in the contractor profile, on the municipal notice board of Huesca, and on the IASS website. Furthermore, it authorizes the modification of the accounting documents of the non-awarded contract to recover the committed credit.

The text is signed by the Managing Director of the Aragonese Institute of Social Services, with the substitute signature of the Technical Secretary General of the Department of Deregulation, Social Welfare and Family, Manuel Díaz Muiña, by order of July 10, 2026. Against the resolution, which does not exhaust the administrative route, an administrative appeal (recurso de alzada) may be filed before the head of that department within one month from the day following its notification.

The setback leaves a public dependency care facility in the capital of Huesca without a headquarters and forces the IASS to rethink the purchase: the planned expenditure is released, but the new elderly care home does not yet have a location or a schedule.
