El Govern deixa sense efectes la convocatòria duplicada de la Cambra d'Eivissa

The Minister of Business, Self-Employed and Energy, Alejandro Sáenz de San Pedro García, has nullified Order 32/2026, of September 25, which called for the elections to constitute the Plenary of the Official Chamber of Commerce, Industry, Services and Navigation of Ibiza and Formentera. The decision is recorded in Order 37/2026, of October 14, published in the Official Gazette of the Balearic Islands (BOIB) no. 131, of October 15, 2026, Section I, page 55336, with edict 10337. The call that remains in effect is Order 34/2026, of October 5, and the date for the polls remains unchanged: November 20, 2026.

A double publication due to a numbering error

The problem originated on October 13, 2026, when BOIB no. 130 simultaneously published two calling acts for the same elections: Order 32/2026, of September 25 (edict 9726, page 55150), and Order 34/2026, of October 5 (edict 10029, page 55171).

According to the preamble of Order 37/2026, the withdrawal of edict 9726 had already been requested on October 7, 2026, to align the numbering of the order with the Agreement of the Governing Council of January 17, 2022, which sets the numbering guidelines for orders from the ministers of the Government of the Balearic Islands. The request for withdrawal was not processed by the BOIB service, which led to the duplicate publication.

Order 37/2026 resolves in two articles: to nullify Order 32/2026 and to declare that the valid call is the one contained in Order 34/2026, published in BOIB no. 130, of October 13, 2026.

The call that remains: fifteen members and voting on November 20

The electoral regime of the Balearic chambers is governed by Law 1/2017, of May 12, on official chambers of commerce, industry, services and navigation of the Balearic Islands, the state basic Law 4/2014, of April 1, and Royal Decree 669/2015, of July 17, which implements it. The electoral process is open by Order ECM/1382/2025, of November 28, between December 1, 2025, and December 31, 2027.

Order 34/2026 establishes the central elements of the process:

  • The Plenary of the Chamber will have 15 members: 10 representing all companies in the census, elected by free, equal, direct, and secret suffrage; 2 representing companies and individuals of recognized economic prestige, proposed by the most representative business organizations; and 3 representing the companies with the highest voluntary contributions.
  • At least one member from the first block and one from the second must have their residence and registered office on the island of Formentera.
  • The Electoral Board of Ibiza and Formentera must be constituted within five days following the publication, with its headquarters at the Department of Enterprise, Self-Employed and Energy, plaça de Son Castelló, 1, 07009 Palma.
  • Voting will take place on November 20, 2026, from 9:00 AM to 8:00 PM, at polling station number 1, at carrer de l’Historiador Josep Clapès, 4, 1a, 07800 Ibiza, and at polling station number 2, at the Chamber’s delegation in Formentera, edificio Aurora, 6, 07860 Sant Francesc de Formentera.

Deadlines for candidacies and mail-in voting

The electoral calendar is anchored to the publication of Order 34/2026 in BOIB no. 130, of October 13, 2026:

  • Candidacies are submitted to the Secretariat of the Chamber or its delegation during the ten business days following the publication, using the standardized form of Order 6/2026, of April 22.
  • Each candidacy requires the endorsement of 5% of the electors of the group or category; if the group exceeds two hundred electors, ten signatures are sufficient.
  • The most representative intersectoral and territorial business organizations have the same deadline of ten business days to designate their candidates.
  • Mail-in voting must be requested in writing within ten business days following the publication, and only votes received at the headquarters of the Electoral Board before 8:00 PM on the day before the elections will be accepted.

The correction directly affects the candidates and the business fabric of Ibiza and Formentera, who had to deal with two call notices identical in content but with different numbering. With Order 37/2026, a single frame of reference is established for submitting candidacies, requesting mail-in voting, and calculating deadlines, so that the electoral process does not stop, but the path to challenges derived from the duplication of the call is closed.
