The Balearic Government revokes a renewable self-consumption subsidy for agricultural use

The Department of Business, Freelancers and Energy of the Balearic Islands has revoked a grant awarded for a self-consumption installation with renewable energies, after verifying that the equipment was intended for an agricultural use not covered by the call for applications. The decision, adopted upon the proposal of the Director General of Circular Economy, Energy Transition and Climate Change, Diego Viu Domínguez, was electronically signed on September 4, 2026, and published in the Official Gazette of the Balearic Islands (BOIB) no. 112, of September 8, 2026, as resolution 8989.

The revoked aid corresponds to file NEXTG45-1010/2021, in favor of Alicia Vicens Perpiña, for an amount of 2,160 euros, intended for an isolated 3.6 kWp photovoltaic installation. The resolution, which exhausts the administrative route, orders the revocation of the grant, the negative disposal of the expenditure charged to the corresponding budget item, and the archiving of the file.

The framework of the call

The grant is part of the public call for aid for self-consumption installations with renewable energy sources, with or without storage, and for the incorporation of storage in existing installations, in the residential sector, public administrations, and the third sector. The call was approved by means of the Resolution of the Councilor for Energy Transition, Productive Sectors and Democratic Memory of September 6, 2021 (BOIB no. 125, of September 11, 2021), modified by the resolution of October 19, 2022 (BOIB no. 137, of October 22, 2022).

The aid is financed within the framework of the European Recovery, Transformation and Resilience Plan (NextGenerationEU), in accordance with Royal Decree 477/2021, of June 29, which approves the direct grant to the autonomous communities for the execution of incentive programs linked to self-consumption and renewable storage.

The reason for the revocation

Technicians from the Directorate General of Circular Economy, Energy Transition and Climate Change examined the documentation provided by the beneficiary and issued an unfavorable report on the justification of the file. According to the resolution, both the cadastral reference and the final work certificate are associated with agricultural use, a purpose that is not contemplated in section 3.1 of the call, which is the reason why the granted aid is revoked.

The procedure followed the prior hearing process: on August 14, 2026, the provisional resolution proposal for revocation was issued (BOIB no. 103, of August 18, 2026), and a period of ten business days was granted to present allegations, which expired without the interested party providing any.

Appeals and consequences

The resolution, issued by delegation of the Councilor for Business, Freelancers and Energy (BOIB no. 97, of July 24, 2025), may be challenged by the beneficiary:

• Potestative appeal for reversal before the Minister of Enterprise, Freelancers and Energy, within a period of one month from the day following publication.
• Contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of the Balearic Islands, within a period of two months.

The revocation entails the loss of the aid and the obligation to return the 2,160 euros received, with the consequent negative disposition of the expenditure charged to budget item G/731A01/78000/00.

Impact for beneficiaries

The resolution highlights the control that the Balearic Administration exercises over European recovery funds, especially in renewable self-consumption programs. Individuals and companies that have obtained these grants must ensure that the installation strictly adheres to the purpose and conditions of the call, as any deviation—such as a use different from what was planned or an unjustified location—may lead to the revocation of the subsidy and the return of the amounts received.
