The Government approves the new statute for State Intelligence personnel

The National Executive Branch approved the new “Statute for the Personnel of the State Intelligence Secretariat of the Presidency of the Nation” through Decree 1021/2026, published this September 16, 2026, in the First Section of the Official Gazette of the Argentine Republic. The measure, signed on September 15 in the City of Buenos Aires by Milei and Diego César Santilli, establishes the labor regime for agents of the National Intelligence System (SIN) and enters into force on the day of its publication.

The decree is issued in exercise of the powers of Article 99, subsection 2, of the National Constitution and Article 25 of the National Intelligence Law No. 25,520 and its amendments, which reserves for the Executive Branch the determination of the duties, rights, remuneration system, categories, and disciplinary and pension regime of the affected personnel. The file was processed under number EX-2026-87102299-APN-SIDE and the statute is incorporated as Annex I (IF-2026-89998923-APN-SIDE), disseminated in the web edition of the Official Gazette.

The text practically replaces the scheme in effect since Decree No. 1088/2003, which had approved the statute of the then Intelligence Secretariat and the civilian intelligence personnel of the Armed Forces. The recitals indicate that, following the creation and subsequent interventions of the former Federal Intelligence Agency, the statute “has undergone repeated modifications” over the last decade and that the lack of a stable personnel regime “undermines the possibility of generating a professional career plan and discourages the incorporation of new talent.”

A career based on suitability and merit

The decree defines the principles that must govern the personnel’s career: suitability, transparency in decision-making, equality, merit, and professionalization with permanent training. The stated objective is to form “a professional body that transcends the political juncture” through entry and promotion processes based on technical, ethical, and professional criteria.

The text also orders the guarantee of proportionality between remuneration, responsibilities, technical capabilities, and hierarchical grades, in order to avoid the discretionary assignment of remuneration among agents with the same function, trajectory, and seniority.

The framework of the system’s reorganization

The measure is supported by the comprehensive reorganization and modernization of the SIN arranged by Decrees Nos. 614/2024, 615/2024, 717/2025 and its amendment, and 941/2025. In that process, the following acting bodies were created within the orbit of the State Intelligence Secretariat (SIDE):

  • Argentine Intelligence Service (SIA)
  • National Counterintelligence Agency (ANC)
  • National Antiterrorism Center (CNA)
  • Federal Cyberintelligence Agency (AFC)
  • General Intelligence Inspectorate (IGI)

The recitals describe the system’s personnel as “specialized public servants who constitute the vanguard of the Nation’s Strategic Security” and maintain that human capital is the most important part of the NIS, as it materializes the direction of intelligence efforts.

Validity and Scope

Article 2 establishes that the measure enters into force as of the date of its publication in the Official Gazette, that is, September 16, 2026. Article 3 provides for its communication, publication, and referral to the National Directorate of the Official Registry.

The detail of categories, remunerative scales, and the complete disciplinary regime is contained in Annex I, which is not part of the published main body and is disseminated in the web edition of the Official Gazette.

With this regulation, the Government provides a unified labor framework for a key area of State security, in the midst of a reorganization process of the intelligence system. The definition of a professional career and objective remunerative rules seeks to provide predictability for agents and, according to the grounds of the decree itself, improve social trust in the functioning of the NIS.
