El Gobierno abre al público los datos del registro estatal de residuos

The Ministry for the Ecological Transition and the Demographic Challenge has determined by ministerial order which information from the Registry of Waste Production and Management will be public. Order TED/1024/2026, of September 30, is published in the Official State Gazette number 246, of October 3, 2026, with reference BOE-A-2026-20530, and enters into force the day following its publication, October 4. The regulation develops article 63.1 and the fourth final provision section 2.h) of Law 7/2022, of April 8, on waste and contaminated soils for a circular economy.

The framework: from the royal decree to the public section

The order is published two days after Royal Decree 764/2026, of September 30, which regulates the Registry and appeared in the Official State Gazette number 243, of October 1, 2026, page 128405 (reference BOE-A-2026-20388). That royal decree created a public section of the Registry in its ninth article and referred the determination of its content to a ministerial order.

The Registry is a shared and unique registry throughout the national territory, integrated into the Electronic Waste Information System (eSIR), in which the autonomous communities incorporate the prior notifications and authorizations derived from Law 7/2022. Its design began in 2013 with the XML standard “E3L” (Environmental Electronic Exchange), used both for data loading and for the exchange of information regarding waste transfers.

The criteria followed to decide what is published are three: the protection of personal data, trade secrets, and the suitability for complying with the principles of hierarchy and proximity of articles 8 and 9 of Law 7/2022.

What information becomes public

The order details in its third article the data that are considered public:

  • Entity identification: name or corporate name and, for legal entities, NIF; for natural persons, first and last names with four random digits of the DNI, NIE, or passport.
  • Address of the entity and, for natural persons, the address of the activity carried out.
  • Center data: NIMA, name, economic activity (CNAE), address and location, as well as the coding when they appear in the State Register of Emissions and Pollutant Sources (PRTR-Spain).
  • Registrations: type and number, and registration date.
  • Authorizations for collection and treatment facilities, managers, and mobile facilities (articles 33.1, 33.2, and 33.5): authorized operations according to annexes II and III, entity operating each operation, waste classified by EWC codes, and data on the end-of-waste status.
  • Prior notifications from agents, dealers, and transporters (article 35): waste classified by EWC codes.
  • Extended producer responsibility systems (articles 49 and 50): products placed on the market, managing entity, territorial scope, and types of members.
  • Recovery or disposal operations without a facility (article 33.4), recovery of excavated natural materials (EWC 17 05 04), and storage in distribution logistics platforms.

Confidentiality and scope of application

The regulation guarantees the confidentiality of data that may be considered a trade secret. Information from PRTR-Spain is only published when the public information thresholds of article 3 of Royal Decree 508/2007, of April 20, are exceeded.

The scope of application covers the autonomous communities and the Cities of Ceuta and Melilla, which are competent to incorporate the data, and the Ministry for the Ecological Transition and the Demographic Challenge, responsible for the maintenance and management of the Register.

Processing and entry into force

The order consists of an explanatory part, three articles, and two final provisions. It is issued under article 149.1.23. of the Spanish Constitution, regarding basic legislation on environmental matters.

During its drafting, the autonomous communities, Ceuta, Melilla, and the Spanish Federation of Municipalities and Provinces were consulted through the Coordination Commission on Waste, and the project was submitted to the Environmental Advisory Council and the Council of State. It is signed by the Minister for the Ecological Transition and the Demographic Challenge, Sara Aagesen Muñoz.

Entry into force occurs on October 4, 2026, one day after its publication.

Impact

The publication of these data will allow management companies, carriers, traders, and agents to consult which entities are registered and will facilitate the procedure for waste transfers within the territory of the State. The Ministry maintains that the measure reinforces legal certainty and environmental transparency, while preserving personal data and trade secrets.
