ENACOM fines FM Vorterix for omitting the 144 hotline

The National Communications Entity (ENACOM) imposed a fine of 3,000 pesos on ZIRMA SOCIEDAD ANÓNIMA, licensee of FM VORTERIX on the 92.1 MHz frequency in the Autonomous City of Buenos Aires, for broadcasting information regarding gender-based violence without mentioning the 144 toll-free telephone line. The sanction is detailed in resolution RESOL-2026-825-APN-ENACOM#JGM, dated August 25, 2026, notified by public notice in the First Section of the Official Gazette of the Argentine Republic on October 15, 2026.

The resolution was issued in case file EX-2023-08523532-APN-SDYME#ENACOM and its communication is carried out via public notice, pursuant to article 42 of Decree No. 1759/72, the mechanism provided to notify interested parties through the official gazette. The text was signed by Juan Martín OZORES, Interventor of ENACOM, and bears a publication date of 10/14/2026 (No. 75815/26).

The invoked sanctioning framework is article 3 of Annex I of Resolution No. 661-AFSCA/14, modified by RESOL-2019-2882-APN-ENACOM#JGM and subsequently by RESOL-2019-2984-APN-ENACOM#JGM. The imputed infringement is article 2 of Law No. 27,039, which mandates the mention of line 144 when broadcasting information about gender-based violence.

The imputed act

According to the resolutive part, on January 19, 2023, starting at 7:13 AM, the station broadcast information about episodes of gender-based violence during the program “MALDICIÓN VA A SER UN DÍA HERMOSO” without making express mention of the 144 toll-free telephone line.

The sanction and payment term

Article 1 applies the fine of THREE THOUSAND PESOS ($ 3,000). Article 2 sets a term of ten (10) business days from notification to make the payment effective. Article 3 orders the measure to be communicated to the General Directorate of Administration, for the purposes of article 103 of Annex I of Decree No. 1,225/10, and to archive the file once the procedure is completed.

Another sanction for the same omission

In the same edition of the gazette, a sanction for an identical infringement was notified to CREAR TELEVISIÓN SOCIEDAD DE RESPONSABILIDAD LIMITADA, for the program “DECONSTRUI2” broadcast on June 8, 2024, at 8:32 PM. In that case, the fine amounted to 403,339 pesos, was ordered by provision DI-2026-1334-APN-DNSYAUYP#ENACOM (case file EX-2024-60681414-APN-SDYME#ENACOM) and signed by Diego Hernán Pioli, National Director of Sanctions and User and Provider Care.

The difference in amount between both cases—3,000 pesos versus 403,339—shows that ENACOM scaled the sanction according to the case, although the omission of the 144 line is the same. For listeners, the obligation to mention 144 in every journalistic report on gender violence remains the central point of the regulation.
