The Constitutional Court admits the appeal against the regional housing law

El Constitucional admite el recurso contra la ley foral de vivienda

The Constitutional Court has admitted for processing unconstitutionality appeal 6911-2026 against the sole transitional provision, sections 1 and 2, of Foral Law 14/2026, of July 2, amending Foral Law 10/2010, of May 10, on the Right to Housing in Navarra. The admission was agreed upon by the Plenary of the high court via a decree dated October 20, 2026, and was made public in the Official Gazette of Navarra number 219, of November 3, 2026, within the judicial proceedings section. The appeal is promoted by more than fifty deputies of the Popular Parliamentary Group in Congress.

The challenged rule is not the foral housing law in its entirety, but rather the 2026 rule that modifies it. Foral Law 14/2026, of July 2, is limited to reforming Foral Law 10/2010, of May 10, a text that remains the current framework for the right to housing in the Foral Community of Navarra and is expressly cited in the bases of other foral regulations, such as those regulating the tax on uninhabited dwellings in various Navarrese municipalities.

A challenge limited to the transitional provision

The object of the appeal is restricted to the sole transitional provision of Foral Law 14/2026, and within it, to sections 1 and 2. The official announcement precisely identifies this point, meaning the challenge does not extend to the rest of the articles of the amending law.

This delimitation is the central technical detail of the published resolution: the Constitutional Court does not announce any other measure regarding the rule in the announcement, and the text is limited to communicating the agreement to admit the appeal for processing.

Plenary Decree and parliamentary support

The admission does not come from a chamber, but from the Plenary of the Constitutional Court, which adopted it by decree on October 20, 2026, in Madrid. The announcement appears signed by the secretary of justice of the Plenary, Alfonso Pérez Camino.

The appeal is signed by more than fifty deputies of the Popular Parliamentary Group in Congress, a threshold that the official publication itself highlights and which places the initiative within the scope of parliamentary standing before the high court, without the announcement detailing the specific grounds for the challenge.

Official publication and chronology

The sequence of the published processing is as follows:

  • July 2, 2026: date of Foral Law 14/2026, which modifies Foral Law 10/2010, of May 10, on the Right to Housing in Navarra.
  • October 20, 2026: the Plenary of the Constitutional Court issues an order admitting unconstitutionality appeal 6911-2026 for processing, in Madrid.
  • November 3, 2026: the Official Gazette of Navarra number 219 publishes the announcement, in section 4, judicial proceedings, under the heading of the Constitutional Court, on page 38842.

The announcement is internally identified in the gazette with the reference J2613861, which allows it to be located in the summary of the official publication of the day.

What this means for tenants and owners

The admission for processing opens the way for the Constitutional Court to rule on the transitional regime introduced by Foral Law 14/2026, a matter that directly affects those who have lease agreements or properties for rent in Navarra subject to Foral Law 10/2010. Until there is a resolution from the high court, the published announcement does not by itself alter the text of the regulation, but it does confirm that its transitional provision is subject to constitutionality control and that the final decision will be adopted within the framework of procedure 6911-2026.
