El Consorcio del Cidacos aprueba el modificado 3 y expropia 65 fincas

The Governing Board of the Water and Waste Consortium of La Rioja approved on October 6, 2026, modified project number 3 for the Cidacos supra-municipal water supply, which alters the layout in the Arnedo branch and at the LR-115 junction, and agreed to initiate the urgent compulsory expropriation of the assets necessary to execute the works. The agreement is published in the Official Gazette of La Rioja number 211, dated Monday, November 2, 2026, with a one-month public exhibition period for the list of affected properties. The case file is 202610290125287 and the document carries the reference BOR-A-20261102-III–4102.

The text, spanning four pages, appears in section III, “Other provisions and acts,” under the heading “Phase I of the Cidacos supra-municipal water supply project. Modified No. 3: approval of the project modification and the contract for the modification of the layout in the Arnedo branch and at the LR-115 junction.” It was signed in Logroño on October 28, 2026, by the general secretary of the consortium, Victoria Barbi Martínez.

The agreement is based on the fact that the Cidacos works are included in the Master Plan for water supply to populations of the Autonomous Community of La Rioja and that the modified project incorporates a specific and individualized list of the assets whose occupation is necessary. Consequently, public utility, the need for occupation, and the urgency of the expropriation are declared, in accordance with articles 17 and following of the Compulsory Expropriation Law of December 16, 1954, and article 13.b) of Regional Law 7/2021.

Prior hearing and contract modification

The first point of the agreement approves modified project number three, granting a hearing to the contractor and the project designer for a period of three business days, with the modification proposal being forwarded for them to submit allegations. The approval is considered final without an express agreement if none are submitted.

The second point opens a hearing process for the town councils of Arnedo and Arnedillo so that, within one month, they may formulate any allegations they deem appropriate within the scope of their competencies. The third point formally initiates the compulsory expropriation proceedings.

65 properties between Arnedo and Arnedillo

The annex to the agreement details 65 properties: two in Arnedillo (polygon 1, plots 1565 and 825) and 63 in Arnedo, of which 56 are rural properties from polygons 10 and 12 and seven are urban properties identified by cadastral reference. Those affected include:

  • Pedro Garrido Fernández, owner of the two estates in Arnedillo.
  • Félix Garrido Galdeano and M Sol Salcedo Quiñones, with two plots in polygon 12.
  • Máximo Merino Salcedo, with five estates in polygon 10.
  • Sergio Hernández Rivas and Natalia Hernández Rivas, with four estates.
  • María Nelli Herce García and the Eguizabal Herce sisters, with four plots.
  • The Arnedo City Council, owner of five estates, including the one with the largest surface area affected.
  • Mega Scorpio Corporación Industrial, SHR Edificación Arquitectónica SL, Colegio Sagrado Corazón-Arnedo, and Martínez Losa Solana María, the latter with land in Navarra.

The definitive expropriation is very small: 40 square meters in plot 1565 of Arnedillo and strips of 4 and 5 square meters in six estates in Arnedo. The bulk of the impact corresponds to aqueduct easements and, above all, temporary occupation.

One month to object and two avenues of appeal

The sixth point establishes the public exhibition for one month of the list of assets and rights, to rectify errors or to oppose the need for occupation on substantive or formal grounds. The publication will be made in:

  • The Notice Board of the Consorcio de Aguas y Residuos de La Rioja.
  • The city councils of Arnedo and Arnedillo.
  • The Official Gazette of La Rioja and the newspaper La Rioja.
  • Individual notification to each affected owner, for the purposes of Article 21 of the Compulsory Expropriation Law.

The agreement also designates the representative of the expropriating Administration, Secretary General Victoria Barbi Martínez, replaceable by the Special Administration technician Oscar Campo Santillán, and the expert Ángel Castillo González, replaceable by Noel Bayo Melero. The text ends the administrative route: a motion for reconsideration may be filed within one month before the Governing Board, or a contentious-administrative appeal within two months before the Contentious-Administrative Court of Logroño.

Impact on the region

The decision affects direct owners in two municipalities and the development of a supply infrastructure declared of supra-municipal interest, included in the Regional Master Plan. The declaration of urgency allows the consortium to occupy the land without waiting for the resolution of appeals, so that the works on the Arnedo branch and the detachment from the LR-115 now depend on the processing of the expropriation file and the payment of the fair price and compensations provided for in the agreement.
