The Minister delegates the management of teaching staff to the Director General

The Minister of Education and Universities, Antoni Vera Alemany, has delegated to the Director General of Teaching Staff and Concerted Centers the exercise of administrative management competencies for non-university teaching staff. The decision is formalized through Resolution 8552, electronically signed on August 21, 2026, and published in the Official Gazette of the Balearic Islands (BOIB) no. 105, of August 22, 2026, in Section III, page 45805. The delegation takes effect from the day of publication.

Regulatory Framework

The resolution is based on Law 3/2003, of March 26, on the legal regime of the Administration of the Autonomous Community of the Balearic Islands, and Law 3/2007, of March 27, on the public service, which allow administrative bodies to delegate the exercise of their competencies to bodies of equal or lower rank. The immediate trigger is Law 4/2026, of June 11, on urgent measures to accelerate strategic projects, which in its twenty-fourth final provision modified the third additional provision of Law 3/2007.

This modification attributes to the minister executive competencies over the civil servant personnel of the assistant faculty body, socio-educational scale, and over the labor personnel of the educational technical assistant specialty. The new resolution replaces and nullifies the Resolution of January 30, 2024, which had delegated similar competencies to the Director General of Teaching Staff and Concerted Centers (BOIB no. 19, of February 8, 2024).

Delegated Competencies

The delegation covers a wide range of matters regarding all non-university teaching staff, from selection to discipline. Among the competencies transferred to the Director General are:

• Convening and resolving selection processes derived from the public employment offer for entry and access to the teaching public service, and establishing its bases.
• Convening and resolving procedures for the provision of job positions, service commissions, and the selection of interim teaching civil servant personnel.
• Appointing and dismissing interim and trainee teaching civil servant personnel.
• Initiating and resolving disciplinary proceedings for teaching staff, except when they involve separation from service.
• Processing and resolving permits, licenses, leaves of absence, retirements, and compatibilities of teaching staff.
• Recognizing triennials, sexennials, and prior service time, and resolving the teaching professional career.

Expanded Scope and Effects

The resolution also incorporates new competencies regarding the civil servant personnel of the assistant body, socio-educational scale, and regarding the labor personnel of the educational technical assistant specialty, with the delegation of the competence to appoint and dismiss interim personnel and to formalize non-permanent employment contracts. Likewise, it delegates the competence to initiate and resolve procedures for the recovery of undue payments in private subsidized educational centers in the Balearic Islands.

The delegation does not alter the competence of the delegating body, which retains ownership and maintains the powers of revocation and avocation. Resolutions adopted by delegation must expressly indicate this circumstance and the identification of the delegating body and the official publication.

Impact

The measure centralizes the daily management of non-university teaching staff in the Balearic Islands within the Directorate General of Teaching Personnel and Subsidized Centers, from selection and appointments to discipline and retirement. For teachers and educational centers, this means that most administrative procedures (permits, licenses, leaves of absence, recognition of triennials and sexennials) will be resolved directly by this body, without passing through the counselor, which should simplify and expedite the procedures.
