The Court of First Instance number 2 of Lugo has agreed to the conclusion of the insolvency proceedings of MONDELO HOSTELERIA SL due to insufficiency of the active estate, which entails the provisional closure of its registration record. The decision, which is final, is published in the Official Gazette of the Mercantile Registry (BORME) number 168, dated September 1, 2026, under the official reference BORME-A-2026-168-27.
Insolvency proceeding 259/2025 was processed before the aforementioned Lugo court, which has also ordered the revocation of the insolvency administrators and the cessation of the limitations on the company’s administrative powers.
The conclusion of the insolvency proceedings
The order concluding the insolvency proceedings, issued on February 14, 2025, by Judge Antón Gato Tellado, is based on the insufficiency of the active estate to satisfy the claims against the estate and those of the debtor company itself. Pursuant to Article 485 of the Recast Text of the Insolvency Law (TRLC), this circumstance determines the provisional closure of the registration record opened for the company.
The registration of the extinction and the registry closure was carried out in the Mercantile Registry of Lugo with the following data:
- Volume and page: S 8, H LU 9382
- Entry: I/A 7, dated August 24, 2026
- Entry number in the gazette: 399328
Revocation of the insolvency administrators
In a subsequent resolution, dated June 4, 2026, Judge Fernando López-Gutián Castro agreed to the revocation of the insolvency administrators appointed in the proceeding. The insolvency administration had been held by AYSE LUCUS SLP, with NIF/CIF B70112222.
With the conclusion of the insolvency proceedings and the revocation of the administrators, the limitations on the powers of administration and disposal that weighed upon the company during the processing of the procedure also cease.
Effects on the company
Conclusion due to insufficiency of the active estate implies that MONDELO HOSTELERIA SL does not have sufficient assets to satisfy the claims, which leads to its extinction and the provisional closure of its registration record in the Mercantile Registry. In practice, this closure prevents the continuation of corporate activity and nullifies previous insolvency annotations.
The publication in BORME number 168, dated September 1, 2026, page 41993, provides official notice of the resolution, so that creditors, partners, and interested third parties may be aware of the final status of the proceeding.
Relevance of the case
The closure of the insolvency proceedings of MONDELO HOSTELERIA SL adds to the trend of proceedings concluded due to insufficient active assets, a scenario increasingly frequent in the hospitality sector, where available assets are not enough to cover the costs of the procedure. For creditors, conclusion via this route means the impossibility of collecting their credits, while for the company, it implies its registration extinction and the end of its commercial life.
