El BOE extingue durante un año la licencia de la comercializadora Luxia Energia

The Official State Gazette publishes this Saturday, October 3, 2026, the resolution by which the authorization of Luxia Energia y Consultores, S.L. to carry out electricity marketing activities is terminated for one year. The measure is issued by the General Directorate of Energy Policy and Mines, under the Ministry for the Ecological Transition and the Demographic Challenge, and entails the transfer of the company’s customers to a reference marketer. The announcement appears in section V-B of BOE number 246, with the official reference BOE-B-2026-32145.

The resolution, signed on October 2, 2026, by the Director General of Energy Policy and Mines, is published in compliance with article 47.2 of Law 24/2013, of December 26, on the Electricity Sector, and articles 41, 45, and 46 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. The company is registered in the marketers’ registry under code R2-1060.

The reason for the proceedings is the failure to comply with the requirement provided for in article 14.4.a) of the General Regulation for the Supply, Marketing, and Aggregation of Electric Energy, approved by Royal Decree 88/2026, of February 11, regarding the submission of the required guarantees. The procedure is not new: on July 30, 2026, the same body agreed to initiate the termination of the authorization and the transfer of the portfolio, an agreement published in the BOE of August 1, 2026 (BOE-B-2026-25864) with a period of ten business days to submit allegations.

One-year termination and portfolio transfer

The first section of the resolution agrees to the termination of the authorization of Luxia Energia y Consultores, S.L. to carry out marketing activities for one year. The second section consequently orders the transfer of its customers to a reference marketer.

The effects of the decision are linked to the effective transfer:

  • The termination of the authorization will become effective the day after the transfer of customers to the corresponding reference marketers is carried out.
  • The precautionary measures adopted in the agreement of July 30, 2026, will be terminated when the termination of the authorization takes effect.
  • The resolution also determines the supply conditions applicable to the affected customers.

Prohibition of transfer to linked companies

The fourth section establishes an additional caution during the extinction period: the transfer of customers who were supplied by Luxia Energia y Consultores, S.L. to any other company within the same business group or to companies linked to it shall not be permitted. For these purposes, the resolution considers linked companies, among others, those that possess or have possessed the same administrator.

Official communications and access to the file

The fifth section orders the communication of the resolution to the involved bodies and agents of the electrical system:

  • National Commission on Markets and Competition (CNMC), so that, once it takes effect, it may remove the company from the list of marketers.
  • System operator and market operator.
  • Reference marketers and distributors.

The full text of the resolution may be requested from the Sub-directorate General of Electrical Energy of the General Directorate of Energy Policy and Mines, upon accreditation of interested party status through the electronic registry. The announcement was signed in Madrid on October 2, 2026, by the sub-director general of Electrical Energy, Carlos Redondo López.

The decision directly affects consumers who had a supply contract with this marketer, who will now be served by a reference marketer without interruption of service, according to the conditions set forth in the resolution itself. The publication in the BOE thus closes a procedure opened in July and provides official record of the exit of Luxia Energia y Consultores, S.L. from the retail electricity market for one year, with the express prohibition of relocating its portfolio into companies of the same group.
