The final judgment regarding the civil service Job Classification List has been executed
Por FactBox Admin

The Ministry of the Presidency, Demographic Challenge, Equality and Tourism of the Principality of Asturias has arranged to execute in its own terms the final judgment of the First Section of the Contentious-Administrative Chamber of the High Court of Justice of Asturias (TSJA) which dismisses the appeal by the College of Civil Engineers against the List of Job Positions for civil service personnel. The decision is formalized through the Resolution of October 1, 2026, published in the Official Gazette of the Principality of Asturias (BOPA) no. 197, of October 13, 2026 (reference 2026-08080). The ruling imposes costs on the appealing party and settles the challenge regarding 16 job positions.
The origin of the litigation dates back to the Agreement of the Governing Council of November 7, 2024, by which the List of Job Positions for civil service personnel was approved, published in the BOPA of November 21, 2024. Against this approval, the College of Civil Engineers filed an appeal for reversal, which was dismissed by the Agreement of the Governing Council of June 9, 2025, notified on June 18.
Having exhausted the administrative route, the professional corporation turned to the contentious-administrative jurisdiction, leading to ordinary procedure no. 653/2025, processed by the First Section of the Contentious-Administrative Chamber of the TSJA. The appeal was filed by Ms. M. R. B., in the name and representation of the professional college. The judgment, issued on June 23, 2026, fully dismissed the appellant’s claims.
Execution of the judgment
The Resolution of October 1, 2026 declares that the judgment has become final and orders the observation of the procedures provided for in Article 26 of Decree 20/1997, of March 20, which regulates the organization and functioning of the Legal Service of the Principality of Asturias in relation to judgments of the contentious-administrative order.
In its operative part, the resolution contains two mandates:
- First: to execute in its own terms the ruling of the reference judgment.
- Second: to order the publication of the resolution in the Official Gazette of the Principality of Asturias.
The content of the ruling
The literal wording of the judgment reproduced in the resolution confirms the dismissal of the contentious-administrative appeal and specifies the scope of the controversy:
- The challenge was limited to 16 job positions within the Job Position Schedule for civil service personnel.
- The appeal against the Government Council Agreement of June 9, 2025, which in turn confirmed the Agreement of November 7, 2024, is dismissed.
- Costs are imposed on the party whose claims were all rejected, with the maximum limit set in the judgment itself.
Costs and administrative effects
The order to pay costs falls upon the College of Civil Engineers (Colegio de Ingenieros de Caminos, Canales y Puertos), although the judgment establishes a maximum limit in accordance with the applicable legal criteria. The resolution was signed in Oviedo on October 1, 2026, by the counselor Gimena Llamedo González.
With this execution, the Job Position Schedule for civil service personnel of the Principality is fully ratified regarding the 16 positions that were the subject of litigation, which consolidates the organizational structure approved by the Government Council and closes the ordinary judicial route opened by the professional college. The publication in the BOPA provides formal effect to the finality of the judgment and confirms that the arguments of the appealing corporation regarding the configuration of those positions do not prevail.
