Educación fija los servicios mínimos ante la huelga educativa del 4 de noviembre

The Department of Education of the Regional Government of Castilla y León has established by order the mandatory minimum services for the educational strike day of November 4, 2026. The regulation, Order EDU/1116/2026, of October 27, is published in the Official Gazette of Castilla y León no. 210, of October 29, 2026 (pages 386 to 390, reference BOCYL-D-29102026-210-24), and enters into force on the day of its publication.

A strike by UGT and Comisiones Obreras

The strike is called by the Public Services Federation of UGT Castilla y León and the Teaching Federation of Comisiones Obreras of Castilla y León and affects personnel in public teaching centers and support services for the non-university educational system dependent on the Department.

The order is based on Article 28.2 of the Spanish Constitution, Article 10 of Royal Decree-Law 17/1977, of March 4, on labor relations, the Basic Statute of Public Employees (Royal Legislative Decree 5/2015, of October 30), and Article 7.2.v) of Law 7/2005, of May 24, on the Public Service of Castilla y León. The text is issued following negotiation with the strike committee and in exercise of the competence delegated by Order PAT/384/2006, of March 10. It is signed by the Minister of Education, María del Valle Ares González.

The resolution clarifies that the measures seek to safeguard the fundamental right to education under Article 27 of the Constitution and that the minimums do not alter the remaining rights and duties of the workers, including the remunerative effects of the strike.

Director and head of studies, general minimums

The annex establishes the mandatory presence of part of the single-person governing bodies in all non-university public centers and support services:

  • The director will guarantee the proper functioning of the school day and facilitate the attendance of those who come voluntarily.
  • As a general rule, the director and the head of studies or, where applicable, the secretary shall remain at the center.
  • In single-unit centers, one teacher.
  • In Grouped Rural Schools and Compulsory Education Centers with scope localities: in the main center, the director and head of studies or secretary; in the remaining localities, one teacher.

The designation of the specific individuals who will provide the minimum services corresponds to the Director General of Education Professionals. The order warns that essential services may not be disrupted and that those who do so will incur liability.

Reinforcements in residences, CRIE, and special education

The annex increases the minimums in centers with residential care or singular specificity, with allocations broken down by province:

  • Ávila: four teachers at the C.E.E. «Príncipe Don Juan».
  • Burgos: one afternoon teacher and one night teacher at the Escuela Hogar «Santa María La Mayor» in Fuentes Blancas; one Special Education support teacher at the CEIP La Charca (Miranda de Ebro), Juan Abascal (Briviesca) and San Isidro (Medina de Pomar); eight morning support teachers and two afternoon teachers at the C.E.E. «Fray Pedro Ponce de León»; three morning and three afternoon teachers at the C.E.E. «Fuenteminaya» in Aranda de Duero.

Appeal within two months

Against the order, which concludes the administrative process, an optional appeal for reversal may be filed before the Counselor of the Presidency or, directly, a contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of Castilla y León within two months from the day following its publication.

The minimum services affect all families with children enrolled in the non-university public network, approximately 2,000 schools and institutes, and the transport, dining, and residence services that depend on them; the centers’ remaining open and staffed during the strike day depends on their application.
