Educación fija el marco de las elecciones sindicales del profesorado no universitario

The Regional Secretariat of Education has established the common framework and the competent bodies for the trade union elections for the non-university teaching staff boards in the Comunitat Valenciana. The resolution, signed on September 29, 2026, by the regional secretary Daniel McEvoy Bravo, is published in the Official Gazette of the Generalitat Valenciana (DOGV) no. 10463, of October 1, 2026, with the reference DOGV-C-2026-30867. The electoral process begins with the constitution of the electoral boards on October 6.

The origin of the procedure lies in the notice that the promoting unions submitted on September 4, 2026, at the public registry office, to hold trade union elections for non-university teaching staff within the scope of the three electoral units of the Comunitat Valenciana. In response, the Department of Education, Culture and Universities considers it appropriate to articulate a common framework for action that determines the aspects of the regulatory norms and facilitates the correct development of the entire process.

The resolution is issued by virtue of the powers attributed by Decree 68/2026, of May 4, of the Consell, approving the Organic and Functional Regulations of the Department of Education, Culture and Universities (DOGV 10358, 08.05.26). The procedure will be governed by Royal Decree 1846/1994, of September 9, which approves the Regulations for elections to the representation bodies of personnel in the service of the General State Administration, whose rules are supplementary for the autonomous communities, and by Order 6/2015, of October 23, of the Department of Sustainable Economy, Productive Sectors, Trade and Labor, which establishes the standardized and mandatory official models.

Competent bodies and constitution of the boards

In accordance with Article 4.2 in fine of Royal Decree 1846/1994, the competent body regarding personnel for the electoral process of non-university teaching staff is the territorial directorate of the respective territorial area. The territorial education directorates will provide the promoting unions with the census of civil servants of the affected electoral unit, distributed by workplaces.

The electoral boards must be constituted on October 6, the date set by the promoting unions as the start of the process. Their composition is specified in the resolution:

  • The coordinating polling stations will be composed of the president, who shall be the official with the most seniority in the electoral unit according to recognized length of service, and two members, the oldest and youngest persons on the census, with the youngest acting as secretary.
  • Those following in terms of seniority, and in oldest and youngest age, shall be designated as alternates.
  • The remaining polling stations will be constituted using the same criteria applied to the census of each station.

Censuses, deadlines, and distribution of polling stations

After the 12 business days of posting the advance notice on the notice board of each territorial education directorate, the territorial director will transfer the advance notice to the officials who are to constitute the coordinating polling station and, where applicable, the polling stations, warning them that the positions are non-renounceable, except in cases of impossibility to attend. At the same time, the promoting unions will be informed of this communication.

The promoting unions may communicate the agreement on the number and distribution of polling stations to the territorial directors of Education until September 30, 2026. The territorial directorates will send the census adjusted to the standardized model to the members of the coordinating stations, and these will prepare the list of voters using the provided means.

Permits, forms, and data protection

The resolution details the permit regime for non-university teaching staff:

  • Members of the three coordinating polling stations will have leave for their full dedication to the tasks of the procedure.
  • The representative designated by the unions on the coordinating station will likewise enjoy leave to attend the sessions.
  • One member of each candidacy, designated by its presenter, will have full-time paid leave from the final proclamation of the candidacy until the day of the vote, both inclusive.
  • Members of the stations and representatives of the Administration will have leave for the time necessary to attend meetings and full-time paid leave on the day of the vote and the immediately following business day.

Each territorial directorate will use the forms provided for in Order 6/2015, of October 23. Regarding data protection, Regulation (EU) 2016/679 and Organic Law 3/2018, of December 5, shall apply, under the processing activity called “Union elections for the non-university teaching staff boards in the service of the Generalitat.”

Effects and appeal process

The resolution shall take effect from the day following its publication in the Diari Oficial de la Generalitat Valenciana. It is not final in administrative proceedings, and an appeal for reversal (recurso de alzada) may be filed before the Minister of Education, Culture and Universities within one month, counting from the day following its publication, in accordance with Article 122 of Law 39/2015, of October 1.

The impact of this resolution is direct for all non-university teaching staff in Valencia: it establishes who organizes the process, how the boards are constituted, which censuses are used, and which permits apply to those involved, so that the union representation of the sector is renewed under a common framework and with deadlines already in effect since October 6.
