The Derio Plenary delegates to the Mayor the construction contract for the Ibaiondo football field

The Derio Municipal Plenary delegates to the Mayor the power to process and award the entire file of a works contract. The delegation was approved in an extraordinary meeting held on September 8 and was published in issue number 178 of the Official Gazette of Bizkaia, on September 17, 2026, with the official reference BOB-2026a178-(II-4795). The agreement takes effect from the day following its approval.

Purpose of the contract

The delegation has a specific works contract as its purpose: the work to build an artificial turf football 11 field, grandstands, and awnings in the old Ibaiondo field. The Plenary, as the contracting body, leaves the decision regarding this file to the Mayor.

Seven specific powers

The agreement specifically lists what the Mayor may do. The delegation does not only include the award; it covers the entire chain from the beginning to the end of the file.

• Approval of the technical works project.
• Approval of the contracting file and the specifications of particular administrative clauses and technical prescriptions.
• Approval of the expenditure corresponding to the file, including the authorization and allocation phases, and the charging of the corresponding budget application.
• Processing and resolving the award procedure, including the classification of offers and the pre-award requirement.
• Awarding the contract.
• Formalizing the contract.
• Other instrumental powers necessary to carry out the above, provided that contract modifications do not exceed the amount of the delegated competence.

Who decides and how

The actions and resolutions issued by the Mayor using this delegation will explicitly state this circumstance, indicating the date of the agreement. Furthermore, for all intents and purposes, including the regime of administrative appeals, they shall be understood as having been issued by the Plenary itself.

The Plenary retains ownership of the delegated competence and may, at any time, invalidate the delegation or take this specific file back for itself. The validity of actions already taken under the delegation shall not be affected.

The agreement will be notified to the Municipal Comptroller and all affected departments.

Appeals and deadlines

The agreement exhausts the administrative route. Interested parties have two options:

• An optional appeal for reversal, before the same body, within a period of one month, starting from the day following the receipt of the notification, according to articles 123.1 and 124.1 of Law 39/2015.
• A contentious-administrative appeal, directly before the Contentious-Administrative Court of Bilbao, within a period of two months, starting from the day following the notification or publication of the act that exhausts the administrative route, according to article 46.1 of Law 29/1998.

Interested parties may use any other appeal they deem appropriate.

Conclusion

The management of the renovation of Derio’s sports facilities remains in the hands of the Mayor in this file, without waiving the ownership of the Plenary. The agreement was signed in Derio by the accidental secretary Elixabete Zorrilla Bernardo, on September 9, 2026.
