Denmark withdraws Charlottenlund forced auction notice after registry error

Statstidende of 6 November 2026 carries a withdrawal of the announced forced auction of the ground-floor apartment at Slotsvej 1 in Charlottenlund, scheduled for 11 November 2026 at 11:00. The notice, published in section I under forced auctions and cancellations, states that the sale is in fact a voluntary auction that was wrongly classified as a forced sale, and that the announcement is therefore retracted. It is registered as document S04112026-42 and was issued in Copenhagen on 4 November 2026.

The retraction appears in the gazette’s running register of cancellations, postponements and re-scheduling of forced sales, the channel through which enforcement notices are corrected once published. The text gives the reason in a single sentence: the auction “er en frivillig auktion, men er ved en ekspeditionsfejl blevet rubriceret som en tvangsauktion og ikke en frivillig auktion”, and because of that clerical error “annoncen tilbagetrækkes”.

The withdrawal is signed by Therése Kemp, Valkendorfsgade 16, 1151 Copenhagen K, the same signatory as the underlying voluntary-auction notice published two days earlier. No new date, valuation or bid deadline is introduced by the withdrawal.

A relabelling, not a cancelled sale

The notice is explicit that nothing has been called off in substance. It states that a voluntary auction over the property continues on 11 November 2026 in the enforcement court in Lyngby at 11:00, and refers readers to the announcement published in Statstidende under the heading “frivillig auktion”.

That underlying notice appeared in Statstidende on 4 November 2026, document S02112026-280, in the register of other legal announcements and voluntary auctions. It sets out the practical terms of the sale:

  • Date and time: 11 November 2026, 11:00
  • Place: Retten i Lyngby, courtroom 3.6
  • Property: matrikel number 0001cr, landejerlav Bernstorff, Slotsvej 1, ground floor
  • Unit for sale: anpart nr. 2, ground floor, in a property divided into two shares
  • Size: 226 square metres in total, distributed over ground floor and basement
  • Minimum bid: DKK 7,000,000
  • Viewing: 29 October 2026, 12:00 to 14:00, by prior registration to ssh@jpb.dk
  • Enquiries: Advokatfirmaet Jon Palle Buhl, telephone 22 74 30 30, journal number 30784001

The voluntary notice also states that the rules on consumer protection in the acquisition of real property, chapter 1, the Danish home-inspection scheme, apply, and that the takeover date is immediate.

A postal code that differs between heading and text

The two documents do not agree on the address. The heading of the withdrawal gives the property as Slotsvej 1, st., 2620 Charlottenlund, while the body of the same notice and the voluntary-auction announcement both give 2920 Charlottenlund. Both descriptions cover the same ground-floor share, identified by the same matrikel number in landejerlav Bernstorff.

The withdrawal itself does not address the discrepancy. It is confined to the classification error, the retraction of the forced-sale announcement and the pointer to the voluntary sale, and it carries no reference to a court order, a creditor or a case number of its own beyond the issuing signature.

Why the distinction matters to bidders

Danish forced sales and voluntary sales are legally different proceedings, and the register keeps them apart precisely because readers rely on the heading to know which regime they are dealing with. Bidders who acted on the forced-sale listing — ordering the inspection reports, arranging finance or attending the viewing — now find themselves dealing with an ordinary voluntary auction held in the same courtroom at the same hour, on the terms of the 4 November announcement.

The practical consequence of the 6 November correction is narrow but important: the sale at Slotsvej 1 has not disappeared from the calendar, only from the forced-auction register. Anyone who concluded from the earlier listing that the auction had collapsed, or that the property would return to a later enforcement round, should check the voluntary-auction notice, where the DKK 7,000,000 minimum bid and the Retten i Lyngby courtroom remain unchanged.
