20 electric mobility grants from the MOVES III program denied

The Department of Enterprise, Freelancers and Energy has denied the granting of 20 subsidies from the MOVES III 2025 program for electric mobility support actions, including four applications from the municipal company EMAYA, SA. The decision, adopted upon the final proposal of the Director General of Circular Economy, Energy Transition and Climate Change, Diego Viu Domínguez, is published in the Official Gazette of the Balearic Islands (BOIB) no. 113, of September 10, 2026, section III, pages 49066 to 49071.

The resolution, electronically signed on September 4, 2026, exhausts the administrative route and is based on the general subsidies Law 38/2003, Legislative Decree 2/2005 approving the Revised Text of the Subsidies Law, and the call approved by the Resolution of the Minister of Enterprise, Employment and Energy of July 1, 2025 (BOIB no. 85, of July 3, 2025).

Grounds for denial

The technical services of the Directorate General of Circular Economy, Energy Transition and Climate Change reported unfavorably on the granting of the aid, after analyzing the allegations presented by the applicants to the provisional proposal of July 22, 2026 (BOIB no. 93, of July 25, 2026). The main reasons are:

• De minimis aid not declared in the application, a fact that prevents the procedure from continuing in accordance with article 69.4 of Law 39/2015 on the common administrative procedure.
• Duplicate files of other applications already registered.
• Investment payments made prior to the registration date of the application, which fail to comply with sections 4.1.b) and 4.2.c) of the guidelines.
• Approval of tender specifications and credit reservation prior to January 1, 2025, which fails to comply with section 4.1.b) of the call.

The case of EMAYA

The municipal company EMAYA, SA accounts for four of the denials (files MOVESIII25-4216/2025, MOVESIII25-4218/2025, MOVESIII25-4229/2025 and MOVESIII25-4232/2025), all for the acquisition of category N1 electric vehicles. In all four cases, the denial is based on the fact that the approval of the tender specifications and the credit reservation are prior to January 1, 2025, a requirement demanded by the guidelines of the call.

Dismissed allegations

Various applicants filed objections against the provisional proposal, which were dismissed by the technical services. Among the most relevant cases are those of Maria Isabel González Fernández (file MOVESIII25-4856/2025), Juan Martin Rodriguez (MOVESIII25-537/2025), Toronaga, SL (MOVESIII25-3592/2025 and MOVESIII25-3597/2025), Francisco José Pariente García (MOVESIII25-4211/2025), Percival Salcedo Martínez (MOVESIII25-2308/2025) and Rafael David Martí Rubio de Cambra (MOVESIII25-2152/2025). In most cases, the technicians confirmed that the undeclared de minimis aid did indeed exist or that the payments had been made before the application.

Against the resolution, the affected parties may file an optional appeal for reversal before the Minister of Enterprise, Self-Employed and Energy within one month, or a contentious-administrative appeal before the Contentious Chamber of the High Court of Justice of the Balearic Islands within two months from publication.

The denial affects both individuals and companies that had applied for grants for the acquisition of electric and plug-in hybrid vehicles and for charging infrastructure, within the framework of a program financed with IDAE funds. For the applicants, the resolution means the loss of grants that could reach 7,000 euros per vehicle, and requires a careful review of the de minimis aid declaration and the payment schedule in future calls.
