The mayoress is absent and delegates all of her duties

The mayoress of La Puebla del Río, M. Dolores Prósper Pérez, has issued Resolution No. 886/2026, dated 13 August 2026, by which she delegates all duties inherent to the Office of Mayoress to the first deputy mayor, Mr Federico Palomeque Bizcocho, for the period between 15 and 23 August, both inclusive. The agreement has been published in the Official Gazette of the Province of Seville, No. 158, corresponding to Monday 17 August 2026, in the Local Administration section.

The resolution is due to the mayoress’s inability to perform her duties as she will be away from the locality during that holiday period. According to the official text, the delegation follows the usual procedure established by current legislation to guarantee the continuity of municipal government in situations of absence, illness or impediment of the office holder.

Legal framework of the delegation

Resolution No. 886/2026 is based on two fundamental provisions of the Spanish local government legal system:

• Article 23.3 of Law 7/1985, of 2 April, regulating the Bases of Local Government (LBRL), which assigns deputy mayors the substitution of the mayoress in cases of absence, illness or impediment.
• Articles 44 and 47 of the Regulations on the Organisation, Operation and Legal Regime of Local Entities, approved by Royal Decree 2568/1986, of 28 November, which specify the procedures for delegation of duties and the acceptance regime.

Local regulations thus provide for an automatic substitution mechanism that prevents the town council from being left without executive leadership during the mayoress’s temporary absences.

Scope of the delegation and duties of the deputy mayor

The delegation conferred on Mr Federico Palomeque Bizcocho is full and covers all mayoral powers. According to the resolution, this includes:

• The powers of direction and management of the municipality.
• The capacity to resolve administrative procedures by adopting administrative acts affecting third parties.
• The institutional representation of the town council during the period of absence.

However, the delegated deputy mayor is obliged to report to the mayoress’s office, retrospectively and in any case whenever required, on the management carried out and the provisions issued during the period in question. Prior consultation with the mayoress’s office shall be required on those decisions of particular significance, as provided for in Article 115 of RD 2568/1986.

Acceptance procedure and publication

For the delegation to be effective, the acceptance of the delegated body is required. However, the resolution establishes that said acceptance is understood to be granted tacitly if Mr. Federico Palomeque Bizcocho does not submit to the mayor’s office an express statement of non-acceptance within three business days counted from the day following notification of the resolution.

Furthermore, Resolution No. 886/2026 orders its publication both in the Official Bulletin of the Province of Seville and on the e-notice board of the city council, and provides that its content be reported to the Plenary of the Corporation at the first session it holds. The mayor, M. Dolores Prósper Pérez, signed the document in La Puebla del Río on August 13, 2026.

Relevance to local government

This temporary delegation is a common administrative procedure in Spanish municipalities during the summer period, when numerous mayors are away from their localities. However, its publication in the official bulletin has full legal effect and guarantees that the decisions adopted by the first deputy mayor during the period from August 15 to 23 have full validity. Residents of La Puebla del Río may direct their requests and inquiries to Mr. Federico Palomeque Bizcocho during those days, who will temporarily hold all powers inherent to the mayor’s office.
