The Ministry of National Defense granted a monthly military survivor’s pension of 34.29 dollars to María Ester Martínez de Mejía, surviving spouse of the former member of the Military Escorts of Neighborhoods, Colonies, and Hamlets, Genaro Napoleón Mejía Alvarado. The decision is contained in Agreement No. 139, signed on September 18, 2026, and published in the Official Gazette on October 5, 2026 (Volume No. 453, page 8). The benefit is recognized with retroactive effect from August 3, 2026, the date of the deceased’s passing.
The process and the legal basis
The agreement is issued “in accordance with the resolution issued by the Ministry of National Defense, contained on folio twenty-one of the proceedings promoted” by the applicant, who proved her status as surviving spouse with Unique Identity Document number zero zero eight one three one zero nine dash one.
The regulation invoked by the Executive Branch is as follows:
- Decree No. 550 of the Revolutionary Government Junta, dated December 22, 1980, published in the Official Gazette No. 241, Volume 269, of the same date.
- Article 1 of Legislative Decree No. 200, dated March 16, 1989.
- Instruction No. 5.061 for the allocation of Pensions and Survivor’s Pensions for Former Members of the Military Escorts, dated November 20, 1996.
- Favorable opinion from the Ministry of Finance, issued in official letter MH.UM.DAJ/001.722/2026, dated September 9, 2026, which considers it appropriate to grant the requested survivor’s pension.
The deceased and evidence of the relationship
The file proves that Genaro Napoleón Mejía Alvarado, with Unique Identity Document number zero zero eight one three zero zero one dash one, was already receiving a State pension in the Defense sector, according to Executive Agreement No. 371 of November 10, 1993, in the amount of three hundred colones per month.
The documents supporting the request are:
- Death Certificate Certification No. DEF-90-2026, which records the death at 1:18 hours on August 3, 2026, due to cardiorespiratory arrest and hydroelectrolytic imbalance, with medical assistance.
- Marriage Certificate Certification number 2, which proves the civil marriage contracted on January 16, 1991.
- Both documents were issued on September 1, 2026, by María José Cruz Gallegos, Family State Registrar of the District of San Isidro, Municipality of Cabañas Este, Department of Cabañas.
Who pays and who signs
Agreement No. 139 stipulates that the sum shall be paid “through the Auxiliary Pay Office for Passive Classes of the Ministry of Finance,” meaning it is charged to the state pension payroll and not to a military operational budget item. The text is signed by Ennio Elvidio Rivera Aguilar, Colonel and Attorney, in his capacity as Vice Minister of National Defense, and closes with the formula “LET IT BE COMMUNICATED.”
The amount coincides with that assigned in another case published in the same Official Gazette on September 24, 2026, when an equal amount was recognized for the surviving spouse of another former member of the Military Escorts, suggesting a uniform calculation criterion for this type of benefit.
Relevance
The case is a testament to the functioning of the Salvadoran military pension system: a benefit activated via executive agreement, requiring a prior ruling from the Ministry of Finance, and calculated based on the pension received by the deceased, which in this case was fixed more than three decades ago in colones. For readers, the document shows the complete administrative circuit—application, proceedings in Defense, fiscal ruling, and official publication—and confirms that the survivor’s pension is recognized from the date of death and not from the resolution, a relevant detail for any family in a similar process.
