Dénia begins the removal of Mongomar as the developer of the Caudeli Partial Plan

The Dénia City Council has agreed to initiate the procedure to resolve, due to non-compliance, the awarding of the developer status for the Caudeli Partial Plan to Mongomar, SL. The agreement was adopted in the plenary session on August 27, 2026, and is published in the Official Gazette of the Generalitat Valenciana (DOGV) No. 10457, dated September 23, 2026, within section V of announcements. The announcement opens a twenty-day public information period for the submission of allegations.

The origin of the decision lies in item 7 of the agenda of the plenary session, under the heading “Planning, management and infrastructure. Reference: 2024/205K. Resolve the awarding of the Developer Status of the Caudeli Partial Plan.” The announcement was signed in Dénia on September 1, 2026, by the mayor-president, Rafael Ferran Carrió Company, and is disseminated for general knowledge.

The three plenary agreements

The plenary agreement is specified in three provisions:

• First. Agree to initiate the procedure for the resolution of the awarding of the developer status of the Caudeli Partial Plan to Mongomar, SL, due to non-compliance with the provisions established in the partial plan.
• Second. Notify Mongomar, SL, in its capacity as the developer of the partial plan, and the rest of the owners who may be affected by the resolution to be issued, and open a twenty-day public information period to formulate allegations and present the documents they deem appropriate.
• Third. Once these procedures have been carried out, transfer the proceedings to the Consell Jurídic Consultiu (Legal Advisory Council) for the issuance of the corresponding opinion.

Public information and affected parties

The procedure is not limited to the developer company. The announcement expressly identifies the recipients of the notification:

• Mongomar, SL, as the developer of the Caudeli Partial Plan.
• The rest of the owners who may be affected by the resolution to be issued.

During the twenty-day public information period, interested parties may formulate allegations and provide the documents they consider appropriate. The announcement does not detail the calculation of the period nor the place of submission, beyond what is provided in the plenary agreement.

Mandatory opinion before resolving

Once the public information process is completed, the file will be sent to the Consell Jurídic Consultiu for the issuance of the corresponding opinion. This step places the final resolution after the consultative process, meaning that the removal of the developer status does not occur immediately upon the publication of the announcement.

The decision directly affects the urban development of Dénia: the resolution of the developer status for a partial plan conditions the management of the sector, the relationship with the affected owners, and the continuity of the planned urbanization works. The owners included within the scope of the Caudeli Partial Plan now have a period of twenty days to defend their position before the file is passed to the advisory body.
