Cuevas del Almanzora expone 30 días la nueva ordenanza de ayudas sociales

The Cuevas del Almanzora City Council has opened the public exhibition of the modification of the Ordinance regulating municipal financial aid for the care of social needs. The Plenary of the Corporation initially approved the new text in an ordinary session on October 26, 2026, and the edict is published in the Official Gazette of the Province of Almería number 212, dated November 3, 2026, under official reference 2984/26. Interested parties have 30 business days to examine the file and submit claims.

The regulation reaches the public information stage after passing the plenary debate and directly affects the framework through which the Cuevas council manages social financial benefits. The edict, signed by the mayor-president Antonio Fernández Liria on October 28, 2026, invokes Article 49 of Law 7/1985, of April 2, regulating the bases of the local regime, and Article 17 of the recast text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004.

The publication is further supported by Articles 45 and 46 of Law 39/2015, of October 1, on common administrative procedure, and the block of Articles 127 and following of the same law regarding good regulation and active publication of norms. The City Council frames the process within the principles of publicity, transparency, and legal certainty.

Initial approval by absolute majority

The plenary agreement was not a unanimous approval: the edict specifies that the modification was approved by an absolute majority of the legal number of members of the Corporation. This qualified majority is what the local legal system requires for general provisions of this type.

The approved text is considered a provision of a general nature, and its processing follows the procedure provided for municipal ordinances and regulations. The complete file remains available to those who wish to consult it during the exhibition period.

The essential data of the process published in the BOP are as follows:

  • Approving body: the Plenary of the Corporation, in an ordinary session.
  • Date of initial approval: October 26, 2026.
  • Date of the edict: October 28, 2026, signed by Antonio Fernández Liria.
  • Publication: Official Gazette of the Province of Almería number 212, dated November 3, 2026, and the entity’s notice board.
  • Official reference of the announcement: 2984/26.
  • Deadline for allegations: 30 business days.

Thirty business days of public information

During that period, which begins to count from the day following the publication of the edict, any interested person or entity may examine the file and submit in writing any claims and allegations they deem appropriate. The announcement does not distinguish between individuals and collectives: the channel is open both to applicants for this type of benefit and to the social entities that collaborate with the City Council in its management.

The period is calculated in business days, meaning that Saturdays, Sundays, and holidays are excluded from the count. Based on the publication date in the BOP, this places the closing of the period in mid-December 2026, except for local holidays that could alter the calendar.

Final approval and entry into force

The edict specifies the effect of administrative silence in this procedure: if no allegations are presented, the agreement that is currently provisional will be definitively approved, as established by Article 49 of Law 7/1985. Therefore, no new plenary vote or new announcement will be necessary for the regulation to be finalized.

Entry into force is also not immediate. According to the text itself, the ordinance will begin to be applied fifteen days after its full publication, in application of Article 70 of Law 7/1985 in relation to Article 65.2 of the same regulation. The City Council justifies the publication of the edict based on the need to protect the principles of publicity and transparency required by good regulation standards.

The relevance of this procedure is direct for residents who depend on municipal financial aid to cover basic social needs: the open period is the only formal opportunity to correct or challenge the text before it is applied. Any allegation submitted within the 30 business days will require an express resolution and could reopen the debate in the Plenary, while its absence will automatically make the modification definitive.
