Cudillero delegates all Mayor's Office functions to Olga Fernández Aguiar until December
Por FactBox Admin

The City Council of Cudillero has delegated all the functions of the Mayor’s Office to the First Deputy Mayor, Olga Fernández Aguiar, during the period between October 26 and December 6, 2026, both inclusive. This is established by Mayoral Decree 979/2026, issued by the Mayor-President on October 22, 2026, and published in the Official Gazette of the Principality of Asturias (BOPA) No. 209, of October 28, 2026, in section IV, Local Administration, with the official reference 2026-08795.
The decree is based on the order of substitution established by the appointment of deputy mayors approved by decree on June 27, 2023, published in BOPA No. 131, of July 10, 2023. The regulation invoked to articulate the delegation is Article 115 of the Regulations on the Organization, Operation, and Legal Regime of Local Entities, approved by Royal Decree 2568/1986, of November 28. The official publication occurred six days after the signing and once the substitution period had already begun.
Six weeks with full authority
The first section of the decree provides that Olga Fernández Aguiar shall assume the substitution of the Mayor’s Office “with the assumption of all the functions” of the councilor’s position. The interval spans from October 26 to December 6, 2026, both days inclusive, which constitutes a period of 42 calendar days.
The stated cause is the temporary absence of the Mayor-President, who signed the resolution in Cudillero on October 22. The text does not detail the reason or the expected duration of that absence beyond the interval set for the substitution.
Direction, management, and decisions regarding third parties
The jurisdictional content of the delegation is specified in the second section and covers three areas:
- Directional powers of the municipal government.
- Ordinary management powers.
- Resolution of the appropriate administrative procedures, including the adoption of administrative acts affecting third parties.
The third section imposes on the delegated body a duty to provide subsequent information to the Mayor’s Office regarding the management carried out and the provisions issued during the period. This duty is also activated whenever the Mayor’s Office requests it and, beforehand, for decisions classified as significant.
Tacit acceptance and immediate effectiveness
The delegation requires the express acceptance of the delegated body for its effectiveness. The decree establishes that such acceptance is understood to be granted tacitly if no statement of non-acceptance is made to the Mayor’s Office within three business days counting from the day following the notification of the resolution.
The same issue of the BOPA includes another municipal action from Cudillero: the final approval of budget modification file 16/2026, in the form of a credit supplement, for the amount of 14,860.12 euros, financed by higher revenues from chapter 5 (patrimonial income) and allocated to chapter 2 (current expenditure on goods and services), in accordance with the announcement reference 2026-08541, signed by the Mayor on October 16.
The substitution decree directly affects the decision-making capacity of the Cudillero City Council for six weeks, a period that includes the ordinary processing of licenses, procedures, and administrative acts with effects on the residents and companies of the council. Any resolution adopted in that interval by the deputy mayor shall have full validity against third parties, and the Mayor’s Office will resume the direct exercise of its functions as of December 7, unless a new resolution is issued extending or modifying the period.
