CSIF recurre los nombramientos de superior empleo de la Policía Canaria

The Official Gazette of the Canary Islands publishes this Friday, November 6, 2026, the announcement from the General Directorate of Security making public the Resolution of July 17, 2026, which orders the referral of the administrative file to Court No. 1 of the Court of First Instance of Santa Cruz de Tenerife, Contentious-Administrative Section. The file is promoted by the Independent and Civil Servants’ Trade Union Confederation (CSIF) against the Administration’s inactivity regarding its request that the nullity of the acts by which certain officials of the General Body of the Canary Islands Police were appointed to higher-employment positions be declared ex officio. The resolution, signed by the Director General of Security, David del Pino Franquet, also includes the summons of all those appearing as interested parties in the procedure.

The origin: an unanswered letter from July 2025

The conflict stems from a letter submitted by the union on July 12, 2025, in which the organization requested the regional Administration to declare the nullity of the disputed appointments ex officio. Having received no response, CSIF pursued the contentious-administrative route through the mechanism of inactivity, which led to abbreviated procedure no. 262/2026.

The judicial body requested the Department via Decree of May 27, 2026, and the General Directorate of Security, under the Department of Presidency, Public Administrations, Justice and Security, has responded by sending the entire file and publishing the summons so that the process can proceed with all guarantees.

What the resolution orders

The administrative pronouncement is specified in two mandates:

  • To refer the administrative file of the procedure promoted by CSIF to Court No. 1 of the Court of First Instance of Santa Cruz de Tenerife, Contentious-Administrative Section.
  • To summon all those appearing as interested parties so that, if they deem it appropriate, they may appear before the judicial body as defendants within a period of nine days starting from the day following the publication of the resolution in the Official Gazette of the Canary Islands.

The action is based on articles 48 and 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, and on article 45.1, letters a) and b), of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

Who may appear and within what timeframe

The call is not addressed only to the defendant Administration, but to any person with a legitimate interest in the outcome of the lawsuit: notably, the officials whose appointments to senior positions are being challenged by the union and who could be affected by an eventual annulment ruling.

The deadline is short and peremptory: nine business days from the day following publication, that is, from November 7, 2026. Anyone who does not appear within that timeframe will not be able to intervene later as a party in the summary procedure.

Another judicial front for the union

This is not the first litigation that CSIF has maintained in the Canary Islands regarding the organization of the public sector: it previously appeared as the plaintiff in ordinary procedure no. 515/2025, brought before the Contentious-Administrative Chamber of the High Court of Justice of the Canary Islands against the order that established the design and structure of the Judicial Office of the Courts of First Instance in the archipelago.

In this case, the object is different and directly affects the professional career within the regional police force, in a context of intense selection activity: the same Bulletin currently contains resolutions from the General Directorate of Studies, Training and Research in Public Security regarding candidates selected for the positions of Sub-Commissioner and Commissioner of the Superior Scale.

The relevance of the news is twofold. For the affected officers, the announcement opens the only window to defend their appointments in court. For the workforce as a whole, the outcome of summary procedure no. 262/2026 will determine whether the criteria applied in filling senior positions in the General Body of the Canary Islands Police are consolidated or must be revised, with possible effects on future fillings and on the organization of the regional police command itself.
