Creixell approves the weapons regulation for the Local Police

The Creixell City Council has definitively approved the Internal Regulation on the use of weapons and tools for police use in the exercise of their functions by the members of the Creixell Local Police force. The regulation, which governs the possession and use of firearms and other police means, is published in the Official Gazette of the Province of Tarragona on September 7, 2026, with the official reference CVE 2026-08192.

The initial plenary agreement was adopted on June 18, 2026 and, as no claims were presented during the public exhibition period, it was automatically elevated to definitive. The document, consisting of 16 pages, is signed by the mayor, Montserrat Muñoz Madueño, with a signature date of August 28, 2026.

A regulatory framework of proportionality

The regulation is framed within the state and Catalan legislation governing police weaponry, especially Royal Decree 137/1993, of January 29, which approves the Weapons Regulation, and Decree 219/1996, of June 12, which approves the Weaponry Regulation for local police. It also incorporates Law 16/1991, of July 10, on local police, and Resolution INT/2789/2018, of November 23, which approves the protocol for the use of energy-conducting devices in Catalonia.

The purpose of the regulation is to ensure the proper use of weapons and tools in the exercise of the functions legally attributed to the force, in compliance with the law and in defense of citizen security. The use of these means does not respond to criteria of personal choice, but must adjust to the principles of congruence, opportunity, and proportionality in the use of force.

Risk levels and force equipment

The regulation classifies the situations in which the use of force may be necessary into three indicative risk levels:

  • Low risk: action without aggression or foreseeable hostile attitude.
  • Medium risk: a hostile attitude towards third parties or officers is manifested.
  • High risk: a hostile attitude is present and aggression is foreseeable, or it has already occurred.

Regarding equipment, the force currently has a WALTHER brand pistol, model P99, 9 mm parabellum caliber. The regulation also governs the energy-conducting device (ECD), the defense or police baton, the expandable baton, personal defense sprays, and the PIEXON JPX 4 pepper pistol with laser, as well as handcuffs and physical restraint straps.

Strict limits on the use of force

The use of firearms is only admissible in the face of a rationally serious risk to the life or physical integrity of the officers or third parties, or in circumstances that entail a serious risk to public safety. It is prohibited to unsheathe or exhibit the weapon for purely intimidatory purposes, and it cannot be used when the proximity of persons unrelated to the events may jeopardize their integrity.

The energy conduction device, for its part, cannot exceed a maximum discharge of five seconds and cannot be used on pregnant women, children under twelve years of age, elderly persons, or in the presence of flammable substances, among other scenarios. Police defense must never be directed at the head, the neck, or other especially vulnerable areas.

Impact on the citizenry

The regulation will enter into force once definitively approved and published in full in the provincial bulletin, and a contentious-administrative appeal may be filed against the agreement before the Contentious-Administrative Chamber of the High Court of Justice of Tarragona within a period of two months. The norm provides legal certainty for both officers and the citizenry by precisely delimiting when and how force may be used in police interventions in Creixell.
