Corte Suprema levanta suspensiones a dos notarios y los reincorpora

The Supreme Court of Justice declared the suspensions imposed on David Ernesto Cuellar Guerrero and Mayra Virginia Calderón González in the exercise of the Public Function of the Notary ended, and ordered both names to be included in the permanent roster of notaries. The decision was formalized in agreements 1876-D and 1890-D, issued by the General Secretariat of the court and published in the Official Gazette Volume No. 453, Number 182, on Thursday, October 1, 2026, in the Judicial Body section, page 6.

The Summary of the bulletin summarizes the publication as “Agreements Nos. 1876-D and 1890-D.- Suspensions imposed in the exercise of the public function of the notary are declared ended.” Both pronouncements were signed by Licenciada Julia del Cid, General Secretary of the Supreme Court of Justice.

The two communications are issued by virtue of the delegation conferred by the Plenary of the Supreme Court of Justice through Agreement 7-P of October 17, 2019, and based on:

  • Articles 24 and 43 of the Administrative Procedures Law.
  • Article 70, obligation 13a, of the Judicial Organic Law.
  • Articles 14 and 182, attribution 12a, of the Constitution of the Republic.
  • Article 13 of the Notary Law.

This framework enables the General Secretariat to execute the administrative acts inherent to the sanctions dictated in the administrative sanctioning processes, that is, to officially communicate the end of each suspension once the Plenary resolves.

The case of David Ernesto Cuellar Guerrero

Agreement 1876-D, dated in San Salvador on September 10, 2026, corresponds to disciplinary file D-349-24 (D-001-CD-24). The Plenary issued a resolution on August 20, 2026, and in it ordered the suspension of Licenciado David Ernesto Cuellar Guerrero to be declared ended, a sanction that had begun on November 20, 2024, and was applied through agreement number 2760-D, of December 16, 2024.

The resolution takes effect as of September 10, 2026, and orders the professional’s name to be included in the permanent roster of notaries. The document was registered under number F49669.

The case of Mayra Virginia Calderón González

Agreement 1890-D, of September 11, 2026, refers to disciplinary file D-159223 (D-025-CM-23). In this case, the Plenary’s resolution was adopted on September 1, 2026, and declares the suspension of Licenciada Mayra Virginia Calderón González ended, a sanction that began on November 13, 2025, and was applied by agreement number 780-D, of April 13, 2026.

The ruling takes effect from September 11, 2026, and also orders the incorporation of the notary into the permanent payroll. The official registration of the document is F49654.

Notices to courts and public registries

In both agreements, the General Secretariat arranged to issue an official letter to inform all Courts and Public Registries in the country, in addition to ordering the publication in the Official Gazette under the formula “LET IT BE KNOWN”. Consequently, the offices that verify a notary’s authorization before authorizing acts or registering instruments are formally notified of the change in status of the two professionals.

Publication in the official bulletin is the means by which the measure acquires general dissemination and opposability against third parties, so that users of notarial services can consult the authorization status of a notary based on the published text.

Impact for users of the notarial service

Reincorporation into the permanent payroll implies that David Ernesto Cuellar Guerrero and Mayra Virginia Calderón González regain full authorization to exercise the Public Function of the Notary, effective from September 10 and 11, 2026, respectively. For pending deeds, powers of attorney, protocolizations, and registration procedures, this means that instruments authorized by both notaries from those dates are backed by a current and officially published authorization.
