Correos del Ecuador will pay its obligations with properties delivered to creditors
Por FactBox Admin

The Public Company Correos del Ecuador CDE E.P. in Liquidation ordered that the payment of obligations corresponding to the real estate assets in its name be fulfilled through their monetization or their delivery as payment in kind (dación en pago) to the creditors. The decision is contained in Resolution No. CDE-EP-LQ-2026-008-R, signed on March 4, 2026, and published in the Official Registry Supplement No. 389 on Wednesday, October 14, 2026, on page 50.
The resolution is issued within the process of the state entity’s extinction, mandated by Executive Decree No. 1056 of May 19, 2020, which ordered the extinction of the Public Company Correos del Ecuador CDE E.P. with the application of the Organic Law of Public Companies, the provisions of the Board of Directors and, subsidiarily, the Companies Law. Executive Decree 26, of December 26, 2025, signed by President Daniel Noboa Azín, extended the liquidation period until June 30, 2026.
Resolution No. DIR-CDE.EP.L-06-2025, of December 8, 2025, replaced Eng. Iván Aurelio Del Pozo Alzamora from the position of liquidator and appointed Eng. Alexandra Estefanía Muñoz Amán in his place. The now-published instrument invokes Article 59 of the Organic Law of Public Companies and that appointment as the basis for the liquidator’s powers.
What the resolution orders
- First Article: instructs the Administrative area to fulfill the payment of obligations corresponding to the real estate assets in the company’s name, “which will subsequently be monetized or delivered as payment in kind to the creditors.”
- Second Article: charges the Financial area of Correos del Ecuador CDE EP in Liquidation with performing the accounting registration of the account receivable in the name of the Ministry of Telecommunications and Information Society (MINTEL).
- Third Article: orders the notification of the resolution’s content to the corresponding administrative areas so that they may proceed with its execution and compliance.
The background: properties already delivered to MINTEL
Report CDE-EP-LIQ-ADM-FIN-2026-010, of March 4, 2026, signed by Mgs. Marco Cedeño, Administrative Financial Coordinator, and Mgs. Marco Díaz, Administrative Director, maintains that it is the responsibility of the receiving ministry (MINTEL) to pay all values related to the delivered assets that are listed in the final delivery-reception acts. The document distinguishes two moments in the equity transfer processes: full liquidation, which requires a public deed for the definitive transfer of ownership, and the provisional reception of assets provided for in Article 3 of Executive Decree No. 778, which allows delivery and administration via a report from the liquidator and the signing of acts.
Report CDE-LIQ-PJ-2026-010, of the same date, signed by Mgs. María Belén Cabrera, Judicial Procurator, indicates that the delivery and reception acts certify the material transfer of the assets, detailing the property number, name of the real estate, cadastral code, and book value. These acts state that MINTEL shall be responsible for the payment of taxes, fees, basic services, expenses and/or quotas, security, and any other obligation generated by the properties from the date of their signing.
Validity and Signing
The Sole Provision establishes that the resolution enters into force as of the date of its signing, in the Metropolitan District of Quito, on the fourth day of the month of March 2026. The document was electronically signed by Ing. Elizabeth Sandoval M., Temporary Notary of the Public Company Correos del Ecuador CDE EP in Liquidation, and by Mgs. Jaqueline Vargas Camacho, Acting Director.
The decision defines the destination of the real estate assets of the state company in liquidation and opens the way for creditors to collect their claims with properties instead of cash. For the creditors and the public entities involved, the instrument also establishes the responsibility of MINTEL over the properties already received, which orders the accounting and administrative closure of the extinction of Correos del Ecuador.
