Comptroller General delegates the review of disciplinary summaries for three months

Contraloría delega por tres meses la toma de razón de sumarios disciplinarios

The Comptroller General of the Republic delegated for three months to the head of the Public Function Division the authority to sign “By order of the Comptroller General” the toma de razón (legal review) of the resolutions of summary proceedings and summary investigations issued by the Health Services and state universities of the Metropolitan Region. The decision is contained in Resolution No. 18, of Santiago, September 21, 2026, published in the Official Gazette of the Republic of Chile No. 44,559, of Saturday, September 26, 2026, Section I, General Norms, pages 1 and 2 (official reference: CVE 2878309). The instrument bears the signature of Dorothy Pérez Gutiérrez, Comptroller General of the Republic.

The resolution is issued under the protection of articles 98 and 99 of the Political Constitution of the Republic, Law No. 10,336, Law No. 18,834, Law No. 18,575, Resolution No. 36 of 2024 of the Comptroller’s Office itself, which establishes rules on exemption from the toma de razón process, and Supreme Decree No. 1,474 of 2024 of the Ministry of Finance.

The text recalls that the toma de razón is a mandatory legality control that safeguards the principles of legality and probity, the right to good Administration, and the proper use of public resources. It adds that article 18, numeral 18.7, of Resolution No. 36 of 2024, subjects dismissals, acquittals, and the application of disciplinary measures in summary investigations and administrative summary proceedings initiated or ordered to be initiated by the Comptroller’s Office to this process.

Which acts are included

The first article of the delegation covers the toma de razón of administrative acts as well as the official letters of scope, instructions, representation, and restitution associated with the resolutions of:

  • The Health Services covered by the Metropolitan Regional Comptroller’s Office of Santiago.
  • The state universities within that same regional coverage.
  • The summary investigations and administrative summary proceedings ordered to be initiated by the Comptroller General of the Republic.

The delegation is limited to the acts that resolve these disciplinary proceedings and does not extend to other matters subject to toma de razón.

Validity, redistribution, and publicity

Article two establishes a temporary validity of three months starting from the entry into force of the resolution, which according to article four governs from its publication in the Official Gazette, that is, from September 26, 2026. Article three orders the Metropolitan Regional Comptroller’s Office of Santiago to adopt the necessary measures to redistribute within the Public Function Division the administrative acts on this matter that are under processing at the regional headquarters as of that date. Article five provides for the incorporation of the act into the online section of administrative acts of the Comptroller’s Office, in compliance with Law No. 20,285 on access to public information.

The fourth recital of the document justifies the measure on the grounds that the Metropolitan Regional Comptroller’s Office of Santiago maintains a high number of acts from the Health Services and state universities under processing that resolve summary investigations and summaries ordered to be instructed by the Comptroller’s Office, which impacts processing times. The delegation seeks an “efficient, agile, and timely” exercise of the functions of the supervisory body.

Impact for officials and services

The decision directly affects public officials of the Health Services and state universities of the Metropolitan Region whose disciplinary processes remained stalled awaiting the legality control. By transferring the signature of the toma de razón (legal review) to the head of the Public Function Division for a limited period of three months, the Comptroller’s Office seeks to reduce the delay in the resolution of summaries that define dismissals, acquittals, or disciplinary measures, with an effect on the official career and on the legal certainty of the procedures.
