Constantina opens the application period to choose its substitute justice of the peace

The Constantina City Council has opened a public call to select the person who will hold the position of substitute justice of the peace in the municipality. The call is approved by Mayoral Resolution No. 388/2026, of September 18, and is published in the Official Gazette of the Province of Seville No. 186, of Thursday, September 24, 2026, on pages 28 and 29, with the official reference BOP-SE-2026-186008. Requirements for applicants
The call details the conditions that candidates must meet, all of which refer to the Justice of the Peace Regulations 3/1995 and the Organic Law of the Judiciary:
- Possess Spanish nationality.
- Be of legal age.
- Not be subject to any of the causes of incapacity established in Article 303 of the Organic Law of the Judiciary.
- Not be subject to any of the incompatibilities and prohibitions regulated in Articles 389 to 397 of the Organic Law of the Judiciary and in Article 14 of the Justice of the Peace Regulations 3/1995.
Article 303 of the organic law declares those physically or mentally unfit for judicial function, those convicted of an intentional crime until they have obtained rehabilitation, those prosecuted or indicted for an intentional crime until they are acquitted or a dismissal order is issued, and those not in full exercise of their civil rights, as incapacitated for entry into the Judicial Career.
Incompatibilities and prohibitions of the office
During their term, justices of the peace are subject to the regime of incompatibilities and prohibitions of Articles 389 to 397 of the Organic Law of the Judiciary, insofar as they are applicable. Article 389 of the Organic Law 6/1985, of July 1, establishes that the position is incompatible, among other cases, with:
- The exercise of any other jurisdiction other than that of the Judiciary.
- Any popularly elected office or political appointment of the State, the autonomous communities, the provinces, and other local entities.
- Employment or positions remunerated by the State Administration, the General Courts, the Royal Household, the autonomous communities, the provinces, and the municipalities.
- Employment of all kinds in the courts and tribunals of any jurisdictional order.
- Any employment, office, or remunerated profession, except for legal teaching or research and literary, artistic, scientific, and technical production.
- The practice of Law and Court Representation (Procuraduría), as well as all types of legal advice, whether remunerated or not.
- The exercise of any commercial activity, by oneself or through another, and the functions of direction, management, administration, or advisory roles in commercial companies and enterprises.
Article 15 of Regulation 3/1995 provides that, if the chosen person were to have any cause of incompatibility, the Governing Chamber may proceed with their appointment if the nominee meets the legal capacity requirements, granting them a period of eight days to certify the cessation of the incompatible activity.
How and where to submit the application
Applications must be submitted using the form provided by the City Council of Constantina, which will also be available to interested parties on the notice board of the municipal electronic office, accessible at https://sede.constantina.es. Submission can be made at the City Council’s entry registry or through the procedure regulated by Article 16.4 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
The election of the substitute justice of the peace corresponds to the Plenary of the City Council, while the effective appointment is formalized by agreement of the Governing Chamber of the High Court of Justice of Andalusia, the announcement of which is likewise published in the provincial bulletin, as occurs with the appointments of titular justices of the peace of other municipalities in the province.
The position directly affects the residents of Constantina, as the justice of the peace assumes municipal functions of conciliation, the processing of certain small-claims civil matters, and the actions that the law attributes to the Civil Registry in municipalities where there is no court of first instance.
