Ministry of Education revokes authorization of vocational training center in Gijón for serious irregularities

The Ministry of Education of the Principality of Asturias has agreed to the extinction of the administrative authorization of the Specific Vocational Training Center Universanidad Gijón II (code 33029317), located at Avenida Hermanos Felgueroso, 25, in Gijón, through express revocation to deliver the intermediate-level training cycle of Guide in the Natural Environment and Leisure Time. The resolution, dated July 30, 2026 and signed by the Minister of Education, Eva Ledo Cabaleiro, is published in the Official Gazette of the Principality of Asturias (BOPA) number 158, of August 17, 2026, with reference 2026-06696. The effects of the revocation will apply from the start of the academic year 2026-2027.

Background: a center authorized since 2008

The center obtained its original authorization through Resolution of May 21, 2008 of the Ministry of Education, published in the BOPA of June 27, 2008, and this has been modified on several occasions, the most recent being the Resolution of July 30, 2024 (BOPA of August 9, 2024). Among the authorized teachings are precisely those of the Guide in the Natural Environment and Leisure Time cycle. However, the Educational Inspection Service of the Principality of Asturias detected a series of irregularities that led to the opening of the extinction proceedings.

Irregularities detected by the Educational Inspection

The investigation, initiated with a report from the Educational Inspection Service of October 16, 2025 and supplemented with reports of October 31, 2025 and May 8, 2026, revealed the following non-compliances:

  • During the academic year 2023-2024, the center delivered in-person classes for the vocational training cycle without holding administrative authorization to do so and concealed this fact from the education administration of the Principality of Asturias.
  • In the academic year 2024-2025, the center again delivered in-person classes for the same cycle and again concealed this fact from the administration.
  • In both academic years (2023-2024 and 2024-2025), the training activities were carried out through other centers, specifically the Centro Privado de Formación Profesional Específica Océano Atlántico, attached to the IES Avempace (Zaragoza), which certified the students’ grades.
  • During the academic year 2024-2025, the in-person activities of the first year were carried out in different premises and spaces from those authorized.
  • In the final ordinary assessment records of the academic year 2024-2025, the grade for a vocational module that had not been taught during that academic year (Técnicas de tiempo libre) was included, without any official certification proving that the students had previously passed it.
  • In the academic year 2025-2026, the center continued to carry out the in-person activities of the second year of the cycle at different times, premises, and addresses from those authorized.

Hearing procedure without response

On 28 May 2026, the hearing procedure regarding the revocation of the authorization was forwarded to the center, granting it a period of fifteen days to submit allegations. However, the notification could not be served: on the home delivery made by the postal service, the box marked “Unknown” was checked. Given the impossibility of personal notification, a notification notice was published on 4 June 2026 in the Supplement of Notifications of the Official State Gazette (BOE). On 16 June 2026, the corresponding notice was also published in the BOPA, setting a period of ten business days to appear before the Dirección General de Centros y Red 0.3 Años of the Department of Education, located at plaza de España, 5, 3.ª planta, Oviedo. No interested party appeared, so the notification was deemed to have been served for all purposes.

Protection of enrolled students

On 27 July 2026, the Inspection Service issued a final report concluding that the revocation, effective from the start of the academic year 2026-2027, would not affect the educational trajectory of the students enrolled at the center during the academic year 2025-2026. This conclusion aligns with the provisions of Article 18.1 of Royal Decree 332/1992, of 3 April, which allows the effects of the revocation to be progressive in order to avoid harm to students.

The resolution is based, among other regulations, on Article 23 of Organic Law 8/1985, of 3 July, regulating the Right to Education (LODE), which establishes that authorization shall be revoked when centers cease to meet the minimum quality requirements. It also invokes Royal Decree 332/1992, of 3 April, on authorizations for private educational centers, and Royal Decree 132/2010, of 12 February. The act ends the administrative route and against it an administrative contentious appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of Asturias, within two months from notification, or a discretionary appeal for reconsideration before the head of the Department of Education within one month.

The revocation of the authorization of a vocational training center due to serious irregularities constitutes a relevant precedent in the supervision of the Asturian education system. The case demonstrates the capacity of the Educational Inspection to detect and sanction the repeated failure to comply with authorization conditions, especially when students’ rights and the basic conditions of quality of the educational service are affected.
