Transfer competition to fill positions in the Public Prosecutor's Office

The Ministry of the Presidency, Justice and Relations with the Courts has announced a transfer competition to fill vacant positions in the Public Prosecutor’s Office, through Order PJC/962/2026, of September 11, published in the Official State Gazette number 229, of September 16, 2026. The call, promoted at the proposal of the Attorney General of the State, opens a period of ten calendar days for prosecutors and fiscal lawyers throughout Spain to request their new destination.
The order is issued under article 36.5 of Law 50/1981, of December 30, which regulates the Organic Statute of the Public Prosecutor’s Office, and articles 63 and following of the Regulations of the Public Prosecutor’s Office, approved by Royal Decree 305/2022, of May 3. The document, published in section II.B (Competitive examinations and competitions), is signed by delegation by the Director General for the Efficiency of the Public Justice Service, Verónica Ollé Sesé.
Who can participate
Second-category Prosecutors and third-category Fiscal Lawyers who have spent more than two years in the position they accessed voluntarily may take part in the competition, as well as fiscal lawyers appointed to their first destination who have spent more than one year in it. Those on voluntary leave for the care of a child or relatives during the first two years, and those reinstated to active service after one year from their appointment, may also compete.
On the other hand, those on voluntary leave without reservation of a post who have requested reinstatement, those coming from a definitive suspension of more than six months, rehabilitated members, and Fiscal Lawyers awaiting destination are obliged to compete, and must request all vacancies in order of preference.
Offered positions and applications
The vacancies are announced in Annex I of the order and are distributed across the national geography, from Andalusia, Catalonia, Madrid, and the Valencian Community to the Canary Islands, the Balearic Islands, Galicia, the Basque Country, Navarra, and Melilla, among other communities. Second-category positions are offered exclusively for prosecutors—such as deputy prosecutors in Ávila and Madrid—, positions for prosecutors or fiscal lawyers, and third-category positions for fiscal lawyers. To these will be added, as residuals, the destinations that become vacant as a result of the assignments themselves.
- Applications shall be submitted exclusively by electronic means, through the registration assistant on the Public Prosecutor’s Office website (fiscal.es).
- Identification shall be carried out using an electronic DNI, digital certificate, Cl@ve Pin 24 h, or permanent Cl@ve.
- The deadline is ten calendar days from the day following the publication in the BOE.
- No applications in paper format will be accepted.
Awarding and conditions
Positions will be awarded based on the highest rank in the seniority list, in accordance with Royal Decree 305/2022. Prosecutors applying for destinations in communities with a co-official language or their own civil law must prove their knowledge, with a minimum language level of A2 and 120 teaching hours of training in civil law. Additionally, requests conditioned by family coexistence are considered, which allow the linking of applications from two prosecutors within the same province or bordering provinces.
The maximum period to resolve the competition will be four months from the end of the submission period, extended due to the high number of positions offered. The Fiscal Inspection will prepare the proposed resolution, which will be communicated to the entire Prosecutor’s Career and submitted to the ministry for approval and publication.
The call affects hundreds of prosecutors and fiscal lawyers throughout Spain and constitutes one of the broadest mobility operations of the Prosecutor’s Career, with a direct impact on the coverage of provincial, area, and territorial prosecutor’s offices. For professionals awaiting destination or on leave, the competition is also a mandatory step to regularize their situation and obtain a definitive destination.
