Temporary concession for the Vientos de La Niña wind farm in Sechura

The Ministry of Energy and Mines (MINEM) granted ENERGÍA RENOVABLE LA NIÑA S.A. the temporary concession for generation plants for the “Central Eólica Vientos de La Niña” project, with an estimated installed capacity of 152 MW. The decision is formalized through Ministerial Resolution No. 382-2026-MINEM/DM, dated September 4, 2026, published in the Legal Norms section of the official newspaper El Peruano on Thursday, September 10, 2026.

The concession is granted for a term of twenty-four (24) months, starting from the publication of the resolution, as established in Article 23 of Decree Law No. 25844, the Law of Electrical Concessions. The project is located in the district and province of Sechura, department of Piura, and will allow the company to conduct feasibility studies for the development of the wind farm.

Regulatory Framework and Procedure

The resolution is based on Law No. 30705, Law of Organization and Functions of MINEM; Decree Law No. 25844, Law of Electrical Concessions; its Regulations, approved by Supreme Decree No. 009-93-EM; the Regulations of Organization and Functions of MINEM, approved by Supreme Decree No. 031-2007-EM; and the Single Text of Administrative Procedures (TUPA), approved by Supreme Decree No. 038-2014-EM.

The application was submitted by the company on June 25, 2026 (Registration No. 4315651), under File No. 27434326. The process included technical reports from the General Directorate of Electricity (Reports No. 600-2026-MINEM/DGE-DCE and No. 629-2026-MINEM/DGE-DCE) and the legal opinion of the General Office of Legal Counsel (Report No. 1218-2026-MINEM/OGAJ), which concluded that the application meets the requirements of Article 23 of Decree Law No. 25844 and Article 30 of its Regulations.

Obligations of the Holder

The temporary concession enables the company to use public-use assets and to obtain the imposition of temporary easements, assuming the obligation to carry out the feasibility studies of the generation plant according to a schedule. Among the conditions established in the resolution, the following stand out:

• Conduct the studies respecting technical and safety standards, preserving the environment and safeguarding the Cultural Heritage of the Nation.
• Comply with the obligations of Decree Law No. 25844, its Regulations, and Directoral Resolution No. 046-2010-EM/DGE.
• Submit the executed studies with the approval of the General Directorate of Electricity.
• Maintain the performance bond in effect; otherwise, the General Directorate will execute the granted guarantee.

The concession area is delimited by the UTM coordinates (WGS84), Zone 17S, as listed in the file. The resolution further mandates its publication once in the official gazette El Peruano, at the company’s expense, in compliance with Article 36 of the Regulations of the Electrical Concessions Law. The resolutive act is signed by the Minister of Energy and Mines, Guillermo Shinno Huamaní.

Regional Impact

The Vientos de La Niña wind farm joins the portfolio of renewable generation projects promoted by the Peruvian State on the northern coast, one of the areas with the highest wind potential in the country. With an estimated installed capacity of 152 MW, the project will strengthen the clean generation matrix of the Piura region and contribute to diversifying the national electricity supply, in line with the sector’s energy transition objectives.
