Begonte City Council notifies edicts of subsidiary execution for forest biomass

Two edicts published in the DOG against plot holders in Begonte

The Begonte Town Council has made public in the Official Gazette of Galicia (DOG) No. 155, corresponding to Tuesday, 18 August 2026, two notices in which responsible persons are informed of the breach of the obligation to manage plant biomass and remove prohibited tree species on plots within the municipal area. These are edicts notifying subsidiary execution and reminder of obligations, published in section VI. Announcements, subsection B) Local Administration, under Article 22.3 of Law 3/2007, of 9 April, on the prevention and defence against forest fires in Galicia.

Law 3/2007 requires owners of forest land and land of forest influence to keep plant biomass properly managed and to remove tree species considered prohibited by the regulations. When the local administration verifies non-compliance by means of an inspection report, it must grant the responsible party a period of 15 calendar days for voluntary compliance. If the period expires without the work being carried out, the council may proceed with subsidiary execution — that is, carry out the work on behalf of the owner and pass on the costs — and, in addition, initiate sanctioning proceedings.

In the case of minor infringements, the pecuniary penalty may reach €1,000, according to Article 74.a) of Law 43/2003, of 21 November, on forests, in relation to Article 50.1 of Law 3/2007. If the infringement is classified as serious, the maximum amount of the penalty rises to €100,000. In both cases, precautionary confiscation of the timber resulting from the felling of the species to be removed is also provided for.

Inspection report: Heirs of Amable Varela Rocha

The first of the notices (reference CVE-DOG: g00bjnn7-kck7-jy58-xcg7-ugimhso2na16, page 45037) is addressed to the Heirs of Amable Varela Rocha, responsible for a plot located next to the Church of Begonte, in Polygon 138, Plot 201. The inspection report was drawn up on 22 June 2026 and recorded non-compliance with Article 21 of Law 3/2007. The edict was signed by the mayor, José Ulla Rocha, in Begonte, on 28 July 2026.

Inspection report: Beatriz Guadalupe Redondo Teijeiro

The second notice (reference CVE-DOG: xvpatno5-pay0-4ud1-v740-mmryhs17hfg9, page 45040) is addressed to Beatriz Guadalupe Redondo Teijeiro, holder of a plot in Prados da Fonte, Begonte, in Polygon 20, Plot 11. The inspection report is dated 1 June 2026. This notice is expressly classified as “notification to unknown holders of the requirement”, indicating that the council unsuccessfully attempted to notify the previous requirement directly to the responsible party.

Impact and access to the land

Both edicts warn that, if non-compliance persists, the Begonte City Council will proceed without further formalities to subsidiary execution, carrying out the provisional settlement of costs and proceeding to their immediate collection. The regulations also authorise the party carrying out the works to access the land without the consent of the holder, except when access affects spaces that may constitute a dwelling for the purposes of Article 18.2 of the Spanish Constitution. The holders of the land or of the exploitation rights have the legal obligation to facilitate the necessary access for carrying out the works.
