Cogolludo delegates the Mayoralty to Rafael Pérez Fernández due to medical leave
Por FactBox Admin

The City Council of Cogolludo has delegated all mayoral functions to the First Deputy Mayor, Rafael Pérez Fernández, for as long as the temporary disability of the mayor, Juan Alfonso Fraguas Tabernero, persists. The decision was adopted through Mayoral Resolution No. 2026-0233, dated October 1, 2026, and is published in the Official Gazette of the Province of Guadalajara No. 190, corresponding to Tuesday, October 6, 2026, within the CITY COUNCILS section.
A substitution supported by local government law
The resolution is based on the legal provision stating that deputy mayors are responsible for substituting the mayor in all their functions, in order of their appointment, in cases of absence, illness, or impediment that make the exercise of their duties impossible. The text confirms the existence of “a cause of temporary disability that prevents the ordinary and continuous exercise of mayoral functions.”
The appointment of Rafael Pérez Fernández as First Deputy Mayor of the Corporation dates back to Decree 2025-0204, of May 28, 2025, which the resolution itself cites as a precedent. The agreement is adopted under Article 23.3 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and Articles 44 and 47 of the Regulations on the Organization, Operation, and Legal Regime of Local Entities, approved by Royal Decree 2568/1986, of November 28.
Scope of delegation and management control
The operative agreement establishes a broad material scope. The delegation includes:
- Municipal direction and management powers.
- The resolution of appropriate administrative procedures.
- The adoption of administrative acts affecting third parties.
The delegation extends from the signing of the resolution until the end of the mayor’s temporary disability. Regarding control, the delegated body must inform the Mayor’s Office, ex post and whenever requested, of the management carried out and the provisions issued during the reference period; furthermore, it must communicate decisions of significance in advance, in accordance with Article 115 of the aforementioned state regulation.
Acceptance, publicity, and appeal process
The effectiveness of the delegation is conditional upon the acceptance of the delegated body. This shall be understood as tacitly granted if no express manifestation of non-acceptance is submitted to the Mayor’s Office within three business days starting from the day following the notification of the resolution.
The text orders its publication in the Official Gazette of the Province and the communication of its content to the Plenary of the Corporation at the first session it holds. Against the decree, which exhausts administrative remedies, the following may be filed:
- Optional appeal for reversal (recurso potestativo de reposición) before the Mayor’s Office of the City Council, within one month from the day following notification.
- Contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance No. 1 of Guadalajara, within two months from the day following notification.
The resolution is signed in Cogolludo on October 1, 2026, by the Mayor-President, Juan Alfonso Fraguas Tabernero, and is disseminated for the purposes provided for in article 44.2 of the local government regulations.
Impact for residents
The delegation temporarily transfers the effective command of the City Council to the first deputy mayor, with the capacity to issue acts affecting third parties, resolve procedures, and direct municipal management throughout the period of the councilor’s leave. For residents and those processing files before the City Council, this means that resolutions, licenses, and ordinary procedures will continue to be signed by the deputy mayor until the mayor returns, without interrupting the administrative activity of the municipality.
