Chiclana somete a información pública su ordenanza contra la contaminación lumínica

The City Council of Chiclana de la Frontera has opened the public information process for the Municipal Ordinance on protection against light pollution and energy efficiency measures, the project of which was initially approved by the Plenary of the Corporation in an ordinary session on September 29, 2026. The agreement is now published in the Official Gazette of the Province of Cádiz (BOP) no. 214, dated November 6, 2026, with reference number 374.283 and under file OBR-35/25. The regulation is open to claims and suggestions for a period of 30 days.

Initial Approval in the Plenary and Publication in the Gazette

The announcement, signed in Chiclana de la Frontera on October 16, 2026, reports on the plenary agreement by which the draft ordinance was initially approved and the opening of a period of public information and express hearing for interested parties was arranged. The processing is officially identified with file OBR-35/25, a reference that must be used in any written submission.

The publication in the BOP took place on November 6, 2026, within issue number 214 of the provincial gazette, which activates the countdown of the legal period for citizen participation. The text signs the announcement with two signatures:

  • M.ª Ángeles Martínez Rico, Delegate for Women, Neighborhood Attention, Urban Maintenance, and Energy.
  • Antonio Aragón Román, General Secretary of the Corporation.

Thirty Days to File Objections and Consult the File

The period of public information and express hearing extends for 30 days starting from the day following the insertion of the announcement in the Official Gazette of the Province of Cádiz, meaning the period begins on November 7, 2026. During this time, any natural or legal person may submit any claims and suggestions they deem appropriate regarding the regulatory text.

The complete file can be examined through the link provided by the City Council of Chiclana de la Frontera in its ordinances and regulations section: https://www.chiclana.es/el-ayuntamiento/plenos-y-normativas/ordenanzas-y-normativas. The Council has not specified other means of in-person consultation in the announcement, therefore the electronic office and the indicated link are the documentary references for the procedure.

Publication on the Notice Board and the Transparency Portal

Along with the hearing process, the Plenary agreed to publish the corresponding announcement on the Municipal Notice Board and insert the draft ordinance into the Transparency Portal, in the section for local regulations in progress. This complies with Article 7.c) of Law 19/2013, of December 9, on transparency, access to public information, and good governance, and Article 13.1.c) of Law 1/2014, of June 24, on Public Transparency of Andalusia.

This double publication—provincial bulletin and transparency portal—places the text within the ordinary circuit of prior exhibition of municipal ordinances before their definitive entry into force.

What happens if no claims are filed

The announcement specifies that, in the event that no claims or suggestions are filed, the agreement, which until then was provisional, will be understood as definitively adopted. In that scenario, the full text will be published in accordance with the provisions of Article 70.2 of Law 7/1985, of April 2, regulating the Bases of Local Government. The entry into force will comply with the period established in Article 65.2 of that same regulation.

The procedure affects the municipal regulation of lighting and energy consumption in the district of Chiclana de la Frontera, a framework that impacts installations and activities within the municipality and which, until now, lacked a specific ordinance dedicated to light pollution.

For residents and owners of lighting installations, the practical relevance of the announcement is twofold: it sets the calendar for allegations—30 days from the day following this publication in the BOP—and determines the moment when the regulation will become enforceable. Anyone wishing to influence the text has until the close of that period to submit suggestions in writing.
