Decree No. 2026-852 of September 9, 2026, published in JORF No. 0211 of September 10, 2026 (NOR AGRT2621409D), makes the departmental chambers of agriculture the single departmental reception point for the establishment and transfer of agricultural holdings. The text, issued by the Ministry of Agriculture, Agri-Food and Food Sovereignty, comes into force on January 1, 2027.

This implementing decree is part of the implementation of Law No. 2025-268 of March 24, 2025, an orientation law for food sovereignty and the renewal of generations in agriculture. It complements the France services agriculture network system, the control framework of which was already established by Decree No. 2026-824 of August 25, 2026, published in JORF No. 0200 of August 28, 2026.

A single window for orientation and support

The decree inserts a subsection 2 “Single departmental reception point” into the rural and maritime fishing code (articles D. 330-18 to D. 330-20). The public establishment in charge of the mission offers any user of the France services agriculture network an interview intended to identify the characteristics, strengths, and limitations of their project to establish or transfer a holding.

At the end of this interview, the reception point presents an exhaustive list of approved advisory and support structures, within the department and neighboring departments, that are objectively suitable for the project. The user’s choice is collected after a reflection period that cannot be less than seven days, and the reception point contacts them regularly during the following year as long as no choice or waiver has been expressed.

Missions entrusted to the departmental chamber

Article D. 511-4 is rewritten to entrust the departmental chamber of agriculture with a public service mission related to the policy of establishment and transfer. In this capacity, the chamber:

  • performs the functions of the single departmental reception point;
  • communicates on support schemes for establishment and transfer, notably through information meetings;
  • supports the applicant for establishment aid by providing forms and informing them of the documents to be supplied;
  • contributes to the processing and monitoring of applications for establishment aid;
  • carries out, at the request of the regional management authorities, the administrative processing of files falling under the programming started in 2023.

The chamber must guarantee the independent and impartial exercise of its mission, remind users of its obligation of neutrality and, if it is itself approved as an advisory structure, signal this prior to the interview. It establishes an annual report transmitted to the departmental prefect and the regional chamber of agriculture.

Transitional Provisions and Installation Registry

The decree also specifies the transitional missions of the chambers. Information regarding installation issues, both collective and individual, is maintained until December 31, 2026. The maintenance of the installation registry (Article L. 330-5) is entrusted to the departmental chamber, with the prefect transmitting the information available to them.

The regional chamber of agriculture may delegate the public service mission related to installation and transfer to the attached territorial chambers. Several orders from the minister in charge of agriculture must specify the interview framework, the content of the information mission, and the conditions for maintaining the registry.

Impact for Farmers

By concentrating the reception, orientation, and monitoring of projects within a single departmental window, this decree aims to simplify the process for installation candidates and transferors, which is central to the challenge of renewing agricultural generations. The Minister of Agriculture, Agri-Food and Food Sovereignty, Ms. Annie Genevard, is responsible for the execution of the text.
