CFE applies new electricity rates for Basic Supply starting in August

The National Energy Commission (CNE) notified the Final Basic Supply Tariffs (TFSB) that the Federal Electricity Commission (CFE), in its capacity as Basic Services Supplier, must apply to its users starting August 1, 2026. The determination was published in the Official Gazette of the Federation on Monday, August 31, 2026, through official letter F00.06.UE/2161/2026 issued by the CNE Electricity Unit on July 31, 2026.

The notification is based on Article 8, fraction VI, of the Law of the National Energy Commission, and Article 11, fraction IV, and 159, first paragraph, of the Electric Sector Law, which empower the Commission to apply the calculation and adjustment methodologies for Basic Supply tariffs. The annual framework was established by Agreement CT/11.SE/8-2025, approved on December 29, 2025, which authorizes the calculation and adjustment of the TFSB for the period from January 1 to December 31, 2026.

An adjustment factor of 0.00%

The central element of the new tariff is the Adjustment Factor for generation charges (energy and capacity), which the Electricity Unit determined to be 0.00% relative to the charges of the immediately preceding month. This implies that, for August 2026, no increase for this concept is passed on to users, in line with the objective of maintaining the stability of final tariffs and mitigating their volatility.

To sustain this adjustment, the Commission recognized an amount of $1,808,000,000.00 (one billion eight hundred eight million pesos) from the differential of generation costs pending accreditation, according to Section A of the Agreement for the calculation and adjustment of the TFSB. The calculation was based on the seasonalized generation costs of August 2026 and the review of costs from CFE power plants, Independent Power Producers, and the Wholesale Electricity Market.

Inter-institutional coordination

The determination was validated within the Coordination Group for the calculation and adjustment of the TFSB, composed of the Ministry of Energy (SENER), the Ministry of Finance and Public Credit, the CFE, and the National Energy Commission itself, which met on July 29, 2026. SENER issued its favorable opinion through official letter 315.028/2026 of the same date.

The notified tariffs are maximums, therefore the CFE may negotiate conventional agreements or tariff discounts with its users, subject to validation by SENER. The administrative act may be challenged through an indirect amparo lawsuit, a contentious-administrative trial, or a review resource, in accordance with applicable legislation.

Publicity obligations

In order to provide maximum publicity to the tariffs, the CFE must comply with the following deadlines:

• Publish the Annex II rates on its website within a period not exceeding 2 business days following the notification.
• Publish the official letter and its annexes in the Official Gazette of the Federation (Diario Oficial de la Federación) within a period not exceeding 20 business days after August 1, 2026.
• Inform the Commission in writing of the compliance with the publication in the DOF within the following 5 business days.

The official letter is accompanied by Annex I, containing the legal basis and considerations for the determination, and Annex II, which contains the applicable tariff tables by division, including the Baja California Division.

Impact for users

The notification of the TFSB of August 2026 directly affects the electricity bills of millions of homes and businesses that receive Basic Supply, a strategic activity that CFE provides exclusively as a State Public Enterprise. By maintaining the adjustment factor for generation charges at 0.00%, the measure seeks to protect the interests of end users and avoid profit, within a context of monthly review of generation costs that will continue to be updated in the coming months.
