Castro Urdiales calls for the payment and occupation of SUNP-3 estates

The City Council of Castro Urdiales has summoned the owners not adhered to the Compensation Board of Sector 2 of the SUNP-3 for the drawing up of the payment and definitive occupation records of their properties, which will take place on Monday, October 26, 2026, on the first floor of the town hall. The summons is published in the Official Gazette of Cantabria number 173, dated September 8, 2026, with reference CVE-2026-6877, within the compulsory expropriation file 58968/2022.
The file was definitively approved by a Plenary agreement adopted in the session of February 24, 2026, processed through the joint appraisal procedure. The summons affects the holders of assets and rights who did not adhere to the Compensation Board of Sector 2 of the SUNP-3 of Castro Urdiales, developable land within the municipality.
Fair Price and Appraisal Sheets
The valuation has been determined based on the submitted appraisal sheets. Appraisal sheets no. 1 and 3 received no disagreement within the granted twenty-day period; therefore, they are understood to be accepted and establish the expropriation fair price according to their valuation.
Regarding appraisal sheet no. 2, as disagreement was expressed, the file has been transferred to the Provincial Expropriation Jury so that this body may establish the fair price. However, by virtue of the urgent occupation provided for in article 179 of Law 5/2022, of July 15, on Land Use and Urban Planning of Cantabria, it is considered possible to proceed with the drawing up of the records without waiting for the Jury’s resolution, with the rights of the expropriated party being guaranteed through the deposit of the provisional fair price.
Deposit and Payment Requirements
The Compensation Board of Sector 2 of the SUNP-3 has proceeded to deposit the fair price in the General Fund of the City Council. To receive payment, interested parties must appear personally or be represented by a duly authorized person and provide, in accordance with article 43.4 of Royal Legislative Decree 7/2015, of October 30, which approves the Recast Text of the Land and Urban Rehabilitation Law:
- Registry certification in their favor with the note from article 32 of the Mortgage Regulations, or, failing that, the supporting titles of their right completed with negative certifications from the Property Registry.
- If there are encumbrances, the holders of such encumbrances must also appear.
- Certificate of ownership of the bank account to receive payment; otherwise, the amount will remain deposited in the General Deposit Fund.
Affected Properties and Holders
The summons calls the owners on the date and time indicated in the attached table, which comprises three initial properties with their cadastral references and registered holders:
- Property 1 (cadastral reference 2409910VP8020N0001QE): Rosario Ruiz Soba, summoned on 10/26/2026 at 09:00.
- Property 2 (cadastral reference 2409909VP8020N0001LE): José Santiago González and María Ángeles Giaconi Vacas, José Eugenio Sauto Solar and Ladislada Ulibarri Solar, Julio Pérez Díez and Oliva García Barreiro, Ana María Magaz Jimeno, Víctor Antuñano Iturbe and José Calzada Rezola, summoned at 09:15.
- Property 3 (cadastral reference 2409908VP8020N0001PE): María Cruz Tobalina Barrenechea, Iratxe Sánchez Tobalina, Alfonso Sánchez Tobalina, María Ángeles Sánchez Tobalina, María Isabel Sánchez Tobalina and Jon Kepa Sánchez Tobalina, summoned at 09:45.
The summons is signed by the mayor, Susana Herrán Martín, dated August 27, 2026. The publication allows those affected to know in advance the date, time, and documentary requirements to formalize the definitive occupation of their land, a key step in the execution of Sector 2 of the SUNP-3 of Castro Urdiales, which affects owners of developable land in the municipality.
