Por FactBox Admin

The City Council of Castrelo do Val has definitively approved the Municipal Ordinance regulating the temporary use of municipal buildings, premises, and facilities, the regulation that establishes the conditions under which associations, entities, and individuals may use public spaces within the municipality. The agreement of the Plenary was adopted on August 19, 2026, and the text is published in the Official Gazette of the Province of Ourense on October 8, 2026, in section IV. Local Entities, with reference R. 2.378. The ordinance will enter into force on the day following its publication in the provincial gazette.
The publication is carried out for the purposes of article 70.2 of Law 7/1985, of April 2, regulating the bases of the local regime, and the edict is signed by the mayor Cristina Gómez Dobarrio on October 6, 2026. The regulation is issued under article 25.2 of the same law and configures the use of these spaces as a special use of public domain assets assigned to public service, subject to administrative authorization and always contingent upon availability once the needs of the municipal programming have been met.
Requests, deadlines, and authorization
Interested natural or legal persons must obtain prior authorization from the City Council of Castrelo do Val, submitting the request at the municipal entry registry according to the model in Annex II, available at municipal offices and on the council’s website. The application must include:
- Data of the applicant (association, entity, or natural person).
- Duration of use, with start and end date and time.
- Building, premises, or facility requested.
- Activity or purpose of the assignment.
- Approximate number of participants.
- Personal data of one or several persons responsible for the activity.
Requests shall be submitted at least fifteen (15) business days prior to the activity, and those that do not respect this deadline will not be attended to except in exceptional circumstances. Non-profit associations must be legally constituted and registered in the corresponding registries and have civil liability insurance. The authorization will be notified by resolution of the Mayor’s Office, in accordance with article 21.1.q) of Law 7/1985, and the resolution will specify the space, dates, schedule, maximum capacity, and rules of use.
Priorities when there are multiple requests
When there is more than one request for the same space for the same date, the council will resolve it based on criteria such as the type of activity (cultural, sporting, conferences), the availability of the premises, the order of entry into the municipal registry, the target audience of the activity, and the temporary duration of the assignment. The City Council of Castrelo do Val maintains priority in the use of the spaces in all cases, even when these have been temporarily assigned, and must notify the beneficiary with sufficient minimum notice.
Premises included in Annex I
The ordinance lists the buildings, premises, and facilities susceptible to use, including:
- Castrelo do Val Multipurpose Center, with sports court and classrooms “Espellos”, P1.1, P1.2, and P1.3.
- Castrelo do Val Interpretation Center and facilities of the Parque do Terrón.
- Headquarters of the Castrelo do Val Council, with the Municipal Library and Teleclube.
- Castrelo do Val Oven, municipal warehouse, and swimming pool facilities.
- Former schools of Servoi, Monteveloso, and Pepín, and the former school of Portocamba.
- Casa do Pobo de Nocedo do Val and social premises of Veiga de Nostre, Nocedo do Val, Campobecerros, Vilar, Fontefría, Sanguñedo, and Piornedo.
- Ovens of Nocedo do Val, Monteveloso, Ribas, Fontefría, Piornedo, and Pepín, and the Velorio de Piornedo.
Fees, infractions, and sanctions
The regulation refers to the fee for the private use of these spaces, whose imposition and regulating fiscal ordinance were initially approved by the Plenary in the session of September 17, 2026, and were subject to public information for thirty business days. Payment of the fee must be made prior to the start of the use of the facilities.
Infractions are classified as very serious, serious, and minor, in accordance with article 140 of Law 7/1985, with the following amounts:
- Very serious infractions: up to 3,000.00 euros.
- Serious infractions: up to 1,500.00 euros.
- Minor infractions: up to 750.00 euros.
Damage to the premises is qualified as very serious when it exceeds 7,500.00 euros, serious between 1,500.01 and 7,500.00 euros, and minor when it does not exceed 1,500.00 euros. Sanctions are independent of any applicable compensation for damages and losses, and failure to comply with the rules or the alteration of authorized conditions entails the annulment of the authorization and the cessation of the activity.
An administrative-law appeal may be filed against the final approval agreement before the Administrative Chamber of the High Court of Justice of Galicia, based in A Coruña, within two months from the day following the publication of the announcement. The regulation provides legal coverage for a common practice in the municipality —the assignment of social premises, ovens, and centers for neighborhood activities— and establishes for the first time clear deadlines, priorities, and a sanctioning regime for entities and neighbors requesting public spaces.
