Castelldefels and the Generalitat sign an agreement to conduct police disciplinary proceedings

The City Council of Castelldefels has commissioned the Department of Interior and Public Security of the Generalitat de Catalunya to conduct the disciplinary proceedings or reserved information inquiry arising from the conduct and actions of a member of the municipality’s Local Police force, which could be subject to disciplinary reprimand. The collaboration agreement formalizing this is published in the Official Gazette of the Province of Barcelona on October 7, 2026, with the official reference CVE 202610148163 and spanning three pages. The agreement is signed by the Secretary General of the Department, Tomás Carrión i Bernal, and the Mayor of Castelldefels, Manuel Reyes López.

The text recalls that the General Directorate for the Coordination of Local Policies, through the Sub-directorate General for Support of the Security System in the Local Sphere, has the function of providing legal and technical support in disciplinary proceedings for local police and security guards. The legal basis for the commission is Article 17.5 of Decree 179/2015, of August 4, which approves the Regulation of the disciplinary regime procedure applicable to local police forces in Catalonia, which empowers the mayor to request the collaboration of the department competent in the planning and coordination of local police.

A management commission between administrations

The agreement is expressly qualified as a management commission, in accordance with Articles 10 and 116 of Law 26/2010, of August 3, on the legal regime and procedure of the public administrations of Catalonia, and Article 11 of Law 40/2015, of October 1, on the legal regime of the public sector. The objective is to establish the framework for collaboration between the two administrations for the processing of the corresponding reserved information or disciplinary file within the scope of the Local Police personnel of Castelldefels.

The electronic signature of the agreement took place on August 26, 2026, and the mayor made it public for general knowledge on September 30, 2026. The capacity of Manuel Reyes López to sign derives from the Agreement of the Local Governing Board of May 29, 2026, while Tomás Carrión i Bernal acts by virtue of Resolution INT/81/2011, of January 18, on the delegation of powers of the Minister of Interior.

Mutual obligations and confidentiality

The distribution of tasks is detailed in the clauses of the agreement:

• The Department of Interior and Public Safety must propose a civil servant of a body or category equal to or higher for the instruction of the reserved information or disciplinary proceedings, and, if appropriate, a secretary.
• The Castelldefels City Council must provide support to the instructor in the communications and notifications of the procedural steps.
• The council must also guarantee the confidentiality and the rights of the person under investigation and the witnesses, limiting access to the file to the persons indispensable for its processing.
• The parties commit to complying with Organic Law 3/2018, of December 5, on the protection of personal data and guarantee of digital rights, and Regulation (EU) 2016/679 (General Data Protection Regulation).

Validity, monitoring and cost

The agreement is valid from the date of signature and enters into force upon its full publication in the Official Gazette of the Generalitat de Catalunya, according to article 112.2 of Law 26/2010. It will remain in effect until the completion of the disciplinary proceedings, that is, until the proposal for the corresponding resolution or report, and for a maximum of four years, extendable for up to four additional years by unanimous agreement of the parties.

To ensure its execution, a Monitoring, Surveillance and Control Commission is created, composed of the secretary of the City Council or the person to whom they delegate, a Human Resources technician from the council, and two technicians designated by the Sub-Directorate General of Support for the Security System in the Local Sphere. The commission will be constituted when a first discrepancy occurs or when one of the parties requests it, and one of the Department’s technicians must draw up the minutes of the meetings. Regarding the economic content, the signature does not entail any expense or economic commitment for either of the two parties, except for those derived from the municipal support to the instructor.

The publication of the agreement makes visible a little-known mechanism of the police disciplinary regime: the possibility that a city council delegates the instruction of a file to the Generalitat to guarantee the independence of the investigator. For the readers of Castelldefels, the agreement implies that the processing of the case will fall to personnel external to the municipal force, with reinforced confidentiality obligations and with a defined maximum term to resolve it.
