Castellar approves the Day Center ordinance for seniors with subsidies

The City Council of Castellar de la Frontera has definitively approved the Regulatory Ordinance for the non-tax public patrimonial payment for the provision of the Day Center service for elderly people, the full text of which is published in the Official Gazette of the Province of Cádiz number 173, dated September 8, 2026 (reference No. 279.571). The regulation sets the rates to be paid by users and establishes social discounts of up to 50 percent based on their economic capacity.

The Plenary of the Corporation, in an ordinary session held on July 1, 2026, agreed to the initial approval of the ordinance, the announcement of which was published in the BOP of Cádiz number 134, dated July 15, 2026, submitting the file to public consultation for a period of thirty days. After this period elapsed without any claim, allegation, or suggestion being presented, according to the certificate issued by the municipal Secretariat-Intervention, and in accordance with articles 49 and 70.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, the agreement is understood to be definitively adopted without the need for a new plenary agreement. The document is signed by the mayor, Adrián Vaca Carrillo.

Nature and management of the service

The regulated provision is considered a non-tax public patrimonial payment, under article 31.3 of the Spanish Constitution and article 20.6 of Royal Legislative Decree 2/2004, given that the service is provided through an administrative concession. The concessionaire company may be responsible for the management of the center, billing, and the collection of fees, always under the supervision of the City Council.

The day center service may include the following services:

• Daytime care assistance.
• Board (breakfast, lunch, and afternoon snack).
• Social care and occupational therapy.
• Basic physiotherapy and cognitive stimulation activities.
• Coexistence activities and adapted transport, if applicable.

Rates and discounts

Users must pay the payment corresponding to the services actually received, in accordance with the current maximum prices/place approved by the Regional Government of Andalusia for day centers for elderly people in a situation of dependency. As of the date of approval of the ordinance, the reference amounts are:

• Day center place under a half-board regime: 27.60 euros/day.
• Day center place under a half-board and transport regime: 37.09 euros/day.

When the regional regulations update said amounts, the rates will automatically refer to the new current prices/place. The social bonuses chapter provides for reductions based on the economic capacity of the user, the granting of which will require a report from the municipal Social Services:

• Income lower than the IPREM: 50% bonus.
• Between 1 and 1.5 times the IPREM: 30% bonus.
• Between 1.5 and 2 times the IPREM: 15% bonus.

Accrual, payment, and non-payment

The obligation to pay arises at the moment the user begins to receive the service, and the provision shall be paid monthly within the first ten days of the month, via direct debit, transfer, or other enabled electronic means. Non-payment of two consecutive monthly installments may lead to a payment request, temporary suspension of the service, or termination of the same.

The ordinance will enter into force after its final approval and publication in the Official Provincial Gazette, remaining in effect until its modification or repeal. Against the agreement, which ends the administrative route, a contentious-administrative appeal may be filed before the Contentious-Administrative Chamber of the High Court of Justice of Andalusia based in Seville, within two months of its publication.

The approval of this ordinance provides legal certainty to an essential service for the elderly of the municipality and their families, by transparently fixing the rates and, above all, by guaranteeing social bonuses of up to 50 percent for lower-income groups, ensuring equitable access to a day care resource.
