Castañeda definitively approves its Municipal Organic Regulation

The Castañeda City Council has definitively approved the Municipal Organic Regulation, a rule that regulates the organization and operating regime of the governing and administrative bodies of the municipality. The agreement was adopted in an Extraordinary Plenary Session held on August 28, 2026, and its full text is published in the Official Gazette of Cantabria number 178, dated September 16, 2026, with reference CVE-2026-7182.

The definitive approval comes after the public exhibition process of the initial agreement, processed under file 230/2026. During that period, two allegations were submitted, which the Plenary has decided to dismiss: the one registered under entry 369, dated July 20, 2026, and the one registered under entry 387, dated July 27, 2026.

Regulatory Framework and Entry into Force

The regulation is issued under the regulatory and self-organization powers that Law 7/1985, of April 2, Regulating the Bases of the Local Regime recognizes for local entities, and complies with the principles of good regulation provided for in Law 39/2015, of October 1, on Common Administrative Procedure. Its preamble invokes the municipal autonomy guaranteed by Article 140 of the Spanish Constitution.

In accordance with Articles 65.2 and 70.2 of Law 7/1985, the regulation will enter into force once the period of fifteen business days from its publication in the official gazette has elapsed. The agreement, signed in Castañeda on September 8, 2026, by the mayor, Marcos García Carrera, may be appealed before the Contentious-Administrative Chamber of the High Court of Justice of Cantabria within a period of two months.

Organic Structure of the Municipality

The text, consisting of 35 pages, defines the necessary and complementary bodies of the City Council and regulates the statute of the members of the corporation, the political groups, and the register of interests. Among the necessary bodies are:

• The Mayor and the Deputy Mayors.
• The Plenary and the Local Government Board.
• The Special Accounts Commission and the Special Suggestions and Complaints Commission.
• As complementary bodies, the Delegated Councilors and the Information Commissions.

The regulation details the powers of the mayor, the procedure for election and resignation from office, the rights and duties of the councilors, the constitution of political groups (with a minimum of two councilors, except for the mixed group), and the regime for declarations of assets and interests before the City Council Secretary.

In-person and Telematic Sessions

A prominent part of the regulation governs the holding of sessions by electronic means, preferably via videoconference, with audiovisual recording that must guarantee its authenticity and integrity in accordance with the National Security Framework. Precise rules are established for the identification of attendees through electronic certificates, the maintenance of a quorum, and the individual voting system.

The regulation also contemplates cases of temporary or definitive disconnection during telemetric sessions, as well as the streaming broadcast of plenary sessions through the electronic office and the municipality’s social networks, reinforcing the public nature of the sessions.

Relevance for the municipality

With this approval, Castañeda provides itself with its own systematic regulatory framework that organizes municipal life, the organization of its governing bodies, and the rights of councilors and citizens. The entry into force of the regulation, which replaces the previous regulatory dispersion, directly affects the daily management of the City Council and the participation of residents in local public life.
