Casas Ibáñez presents the modification of the water ordinance for public review
Por FactBox Admin

The Casas Ibáñez City Council has opened the public information process for the modification of the Municipal Ordinance regulating the non-tax public heritage payment derived from the provision of the domestic drinking water supply service. The initial approval was adopted by plenary agreement in an urgent extraordinary session on October 29, 2026, and the announcement is published in the Official Gazette of the Province of Albacete number 128, dated November 4, 2026, under announcement number 29.907.
Initial approval in an urgent extraordinary plenary session
The plenary body of the council gave the initial green light to the reform of the regulation governing the municipal collection for domestic drinking water, and the agreement is now transferred to the Gazette for public exhibition. The announcement appears in the Third Section, Local Administration, on page 14 of Gazette number 128, signed by the mayor, José María García Martínez, in Casas Ibáñez on October 30, 2026, one day after the plenary session.
The urgent extraordinary call implies that the corporation resolved the initial approval without following the ordinary order of sessions, so the modification enters the public exhibition circuit with the plenary agreement already adopted and awaiting allegations.
Thirty days to examine the file
The period enabled for citizen participation is 30 days, counted from the day following the insertion of the announcement in the Official Gazette of the Province. During this period, the file may be examined by interested parties, and any claims deemed appropriate may be submitted.
The points established by the announcement are:
- Public exhibition period: 30 days from the day following the publication in the BOP.
- Object: the modification of the ordinance for the domestic drinking water supply service.
- Open process: examination of the file and submission of claims by interested parties.
- Effect of allegations: they require a resolution before final approval.
The announcement does not reproduce the articulated text of the ordinance nor the detail of the tariffs; therefore, the concrete content of the reform can only be consulted in the municipal file during the exhibition period.
A regulation on the water bill as a non-tax payment
The ordinance does not regulate a tax, but rather a non-tax public heritage payment linked to the domestic drinking water supply service. This classification determines the legal regime for the municipal collection of water and the service conditions for users, and it is the instrument that the council is now reforming.
The modification therefore affects the regulatory framework for receipts and supply conditions applied by the City Council to those supplied within the municipal district of Casas Ibáñez.
Legal basis and effects if there are no claims
The agreement is supported by articles 49 and 40.2 of Law 7/1985, of April 2, regulating the Bases of the Local Regime, and by article 56 of the consolidated text of the legal provisions in force regarding the Local Regime, approved by Royal Legislative Decree 781/1986, of April 2.
The announcement specifies that, if no claim is filed during the public exhibition period, the plenary agreement will be considered final, in accordance with article 49 in fine of Law 7/1985. That is, the initial approval is automatically elevated to final, and the new ordinance is closed without the need for a second express plenary pronouncement on the allegations.
The reform reaches the Bulletin with no claims registered as of the date of publication, as the 30-day period begins to count precisely from the day following the insertion of the announcement.
The relevance for residents is direct: the water ordinance is the regulation that supports the billing of the supply and the conditions of the service in the municipality, and the calendar leaves a limited margin to review the file. Anyone who does not present allegations within the 30 days will see the modification consolidated without further formality, so the period opened with this announcement is the only formal opportunity to intervene before the text is definitively approved.
