Capdesaso delegates municipal urban planning discipline to Aragón

The Capdesaso City Council unanimously approved, in an Ordinary Session held on July 7, 2026, to delegate to the Administration of the Autonomous Community of Aragon the exercise of its competencies regarding urban planning discipline. The agreement, signed by Mayor Raúl Peralta Buisán on August 27, is published in the Official Gazette of the Province of Huesca number 165, dated August 31, 2026, with reference BOPH-2026-165005.
The delegation is based on the Fourteenth Additional Provision of the Recast Text of the Urban Planning Law of Aragon, approved by Legislative Decree 1/2014, of July 8, and introduced through article 38.5 of Law 2/2016, of January 28, on Fiscal and Administrative Measures of the Autonomous Community of Aragon. This regulation enables municipalities with fewer than five thousand inhabitants to transfer the control of urban planning legality within their jurisdiction to the Autonomous Community.
Scope of the delegation
The ceded competencies include the powers of urban planning inspection, protection of legality, and sanctioning regarding acts of transformation, construction, building, or uses of the soil or subsoil without an enabling title or execution order, or against the conditions specified therein, whether ongoing or already completed. Only cases that can be classified as a serious or very serious urban planning infringement and that are totally or partially incompatible with the current urban planning regulations are transferred.
- Action by delegation shall correspond to the Director General competent in urban planning matters.
- The resolution of administrative appeals shall be exercised by the Regional Minister competent in urban planning matters.
- Resolutions issued by delegation shall expressly indicate this circumstance and shall be considered issued by the delegating body.
Economic and effectiveness regime
The agreement also regulates the distribution of the economic effects of the delegation. Amounts derived from the imposition of urban planning sanctions shall be credited in favor of the delegating Administration (the City Council), while the enforcement procedure for sanctions not paid during the voluntary period shall be promoted and processed by the delegating Administration itself through its usual channels.
- Expenses to enforce measures for the restoration of urban planning legality shall be borne by the delegating Administration.
- Necessary inter-administrative collaboration and cooperation mechanisms shall be adopted.
- The delegation shall enable the full exercise of competencies until its revocation and corresponding publication occur.
Processing and entry into force
The agreement was adopted by the Municipal Plenary and is published in the Official Gazette of the Province of Huesca, as required by the regulations. The effectiveness of the delegation will further require the acceptance of the Government of Aragon and its publication in the Official Gazette of Aragon. Any delegation between Administrations shall enable the full exercise of competencies until its revocation is published in the corresponding provincial gazette.
The decision by Capdesaso is part of the trend among small Aragonese municipalities to strengthen the protection of urban planning legality through collaboration with the Autonomous Community, which possesses greater technical capacity and means for inspection and sanctioning. For the residents, it represents an additional guarantee that illegal activities on the municipality’s land and subsoil will be pursued more effectively.
