Capafonts eliminates an administrative assistant position and dismisses the worker
Por FactBox Admin

The Plenary of the Capafonts City Council initially approved, in an ordinary session on September 24, 2026, the modification of the personnel staff consisting of the amortization of one position for an administrative assistant (labor personnel). The agreement, processed by the Secretariat Area under file 4303980001-2026-0000151, is published in the Official Gazette of the Province of Tarragona on October 2, 2026 (reference CVE 2026-09054, pp. 1-5). The suppression of the position opens the way for the termination of the contract of the worker occupying it through a dismissal for objective reasons, with an effective date scheduled for November 30, 2026.
The agreement was adopted unanimously and is initial in nature: it is subject to public consultation for fifteen days and, if no claim is presented, it will become definitively approved without the need for a new plenary agreement. The competence lies with the Plenary and is not delegable to the mayor’s office or the Local Government Board, in accordance with article 22.2.i) of Law 7/1985, of April 2, regulating the bases of the local regime.
A 32-hour position that no longer fits the needs
The affected position is for labor personnel, assistant category, on a part-time schedule of 32 hours per week. According to the justification of the file, its functions are assimilable to those of an administrative assistant position of subgroup C2, but the experience accumulated in the ordinary operation of municipal services has demonstrated that this configuration “no longer suits the structural and permanent needs of the City Council.”
The municipal body argues that the reduced size of the organization and the limitation of human resources force administrative staff to assume a high degree of versatility, autonomy, and responsibility. The profile considered necessary must be able to fully process files, control deadlines and procedures, prepare requirements and notifications, manage electronic platforms, and coordinate with technical services and other administrations.
The City Council maintains that keeping the current position would involve structurally assigning it functions that exceed its category, and that it is not budgetarily justified to simultaneously maintain an assistant profile and a new administrative position.
Savings of 25,138 euros and termination schedule
The reports supporting the file are as follows:
- August 31, 2026: report from the Secretariat Unit justifying the necessity and convenience of the amortization.
- August 31, 2026: report on the applicable legislation and legal procedure.
- September 8, 2026: favorable report from the Comptroller’s Office regarding the expenditure.
The intervention figures the structural expenditure reduction at 25,138.44 euros annually, with an estimated saving of 3,168.13 euros during the 2026 financial year. The report indicates that there is sufficient credit to cover the amounts owed until the termination of the contract and the corresponding compensation, so no credit modification needs to be processed.
The effective date of the amortization is set for November 30, 2026, coinciding with the date planned for the termination of the contractual relationship. The effectiveness of the amortization is conditional upon the final approval of the staffing modification and the separate processing of the dismissal procedure for objective reasons, which will be governed by articles 51 and 52.c) of the Revised Text of the Workers’ Statute Law.
Fifteen days for allegations and subsequent processing
The agreement is submitted for public information for a period of fifteen days via an announcement in the Official Gazette of the Province of Tarragona. During this period, interested parties may examine the file at the City Council Secretariat and present allegations or claims before the Plenary.
Once the modification is approved, a copy must be sent to the State Administration and the Department of Governance of the Generalitat de Catalunya within thirty days, without prejudice to the full publication in the Official Gazette of the Province, the Official Gazette of the Generalitat de Catalunya, and the Transparency Portal. As it is a procedural administrative act, no appeal may be filed against the resolution, although interested parties may submit allegations.
The agreement is signed by the mayor, Sergi Serra Monné, with an electronic signature date of September 29, 2026.
The decision is unusual for a small municipality where the staff is very limited: the suppression of a position and the objective dismissal of the person occupying it reduce the number of municipal personnel and shift more processing burden to the remaining staff. For the residents, the file is also a window into the financial and organizational situation of the City Council, which in the same plenary session approved credit modifications worth 71,359.14 and 64,223.72 euros.
