Cantabria and Argoños sign an agreement to demolish 225 homes

The Official Gazette of Cantabria publishes in issue number 163, dated August 25, 2026, the resolution providing for the publication of the Framework Collaboration Agreement between the Government of Cantabria and the City Council of Argoños for the coordination of the technical, legal, and economic assistance necessary for the execution of demolition judgments. The agreement, signed in Santander on August 18, 2026, affects 225 homes in the municipality whose licenses were annulled in judicial proceedings.

The resolution, with reference CVE-2026-6656, was issued on August 19, 2026, by the general secretary of the Ministry of Public Works, Housing, Territorial Planning and Environment, Ana Belén Ruiz San Millán, and is published on pages 40313 to 40319 of the gazette.

An urban planning conflict of more than two decades

The agreement is rooted in September 2011, when the Government of Cantabria developed, together with the city councils of Argoños, Arnuero, Escalante, Miengo, Piélagos, and San Vicente de la Barquera, a proposal for the execution of judgments that carry orders for the demolition of homes. In March 2020, the update of that plan was approved and forwarded to the competent judicial bodies.

The 225 affected homes are located in different areas of the municipal district and were built under licenses annulled in court. In several cases, the annulments were due to actions for which the City Council of Argoños held exclusive responsibility, without the participation of the regional Administration.

Municipal liability files

The agreement details the groups of homes for which liability was declared exclusively municipal:

• 19 homes in the Las Llamas I Urbanization, annulled by appeals 183/1999, 181/1999, 184/1999, and 185/1999 before the Administrative Litigation Court No. 1 of Santander, due to landscape impact.
• 5 homes from the “Pepín Cano” license (one already demolished and two municipally owned) and 4 homes from the “Munargo” license, annulled by appeal 1997/1999 before the High Court of Justice of Cantabria.
• 16 homes from the “SATEC” license, annulled by consolidated appeals 1200/1998 and 1914/1998.
• 12 homes from the “Santiago Martínez de Isla” license, annulled by appeal 1992/1998.

The execution of these judgments is pending a compliance plan approved by the courts, through which the City Council contributes an annual amount until the guarantee of article 108.3 of the LJCA is completed, extending until the year 2034.

Regional assistance and monitoring

The agreement, signed by Councilor Roberto Media Sainz and Mayor Juan José Barruetabeña Manso, provides that the Government of Cantabria will provide technical and legal collaboration in the drafting of conventional termination proposals with the owners, and will provide financial assistance to the City Council when the allocated amounts prove insufficient to satisfy the patrimonial liabilities. The management of the files will remain a municipal competence.

For its implementation, a Joint Monitoring Commission will be established, chaired by the Ministry of Public Works, Housing, Territorial Planning and Environment and composed of three representatives from each party. The agreement, authorized by the Governing Council and the municipal Plenary on August 6, 2026, will be effective from its publication and will extend until its objectives are achieved.

Impact for the owners

The agreement articulates a coordinated response between the regional and local Administrations to resolve a problem that directly affects the owners of the 225 homes, guaranteeing them greater legal and economic security in the execution of the demolitions. The signing does not, under any circumstances, imply the recognition of administrative or judicial liability by the Government of Cantabria in cases already resolved by the courts.
