Cangas del Narcea definitively approves the terrace tax for the hospitality industry

The Cangas del Narcea City Council has definitively approved the modification of fiscal ordinance number 32, which regulates the fee for the occupation of public domain with tables, barrels, awnings, canopies, and similar elements for profit-making purposes. The automatic elevation to definitive status occurs as no claims or suggestions were filed against the provisional agreement of the Plenary on June 25, 2026, and the full text is published in the Official Gazette of the Principality of Asturias number 184, dated September 23, 2026, with reference Code 2026-07626.

The provisional agreement had been published in the Official Gazette of the Principality of Asturias number 135, dated July 15, 2026, and was automatically elevated to definitive status in accordance with article 17.3 of the consolidated text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5. The processed file is File TES/2026/80 and the announcement appears signed by the Mayor in Cangas del Narcea on September 14, 2026. The regulation is issued under the protection of articles 133.2 and 142 of the Constitution and article 106 of Law 7/1985, of April 2, regulating the Bases of Local Regime.

Rates per square meter

The fee is calculated by minimum surface modules: four square meters for a table or barrel with four chairs or stools, two square meters for a table or barrel with two chairs or stools, and one square meter for a barrel without stools. The applicable rates are as follows:

• Occupation with tables, chairs, and barrels, annual: 39.84 euros per square meter in first-category streets, 34.86 euros in second-category, and 29.88 euros in other areas.
• Same occupation, seasonal: 19.92 euros, 18.26 euros, and 16.60 euros per square meter according to category.
• Sporadic occupation: 1.00 euro, 0.83 euros, and 0.66 euros per square meter per day.
• Canopies fixed to the public road: identical amounts to the first rate.
• Extendable awnings, annual: 29.88 euros, 26.56 euros, and 23.24 euros per square meter; seasonal, 14.94 euros, 13.28 euros, and 11.62 euros.

The ordinance does not establish any type of discount or exemption.

Requirements and limits of occupation

All occupation requires a prior municipal license or authorization, which must be displayed in a visible place within the establishment, and the application must include proof of ownership, the maximum number of meters to be occupied, the elements to be installed with photographs, the methods of anchoring, and a detailed plan of the area. Multiple elements must be identical in shape and color across the entire granted surface, and occupations with plastic elements or advertising will not be authorized.

• The authorization shall reserve a minimum space of 1.5 meters in width for the normal use of pedestrian streets and sidewalks.
• Exceptionally, on sidewalks, narrowings shall be permitted, which must never be less than one meter and have a maximum length of six meters.
• Non-extendable awnings of less than 1.5 meters, whose width does not exceed each side of the door by more than 30 centimeters, do not constitute a taxable event.
• The occupation of a larger surface area or the exceeding of the deadline generates a complementary settlement with a surcharge of 5 euros per meter per day.

Deadlines, management, and appeals

The occupation period may be annual, from January 1 to December 31; seasonal, from May 1 to September 30; or sporadic, with a maximum of one week and reserved for dates such as Holy Week, Narcenatur, the Harvest Festival, or long weekends. Applications are submitted by December 1 of the previous year for annual occupations, by April 1 for seasonal ones, and up to one month before the event for sporadic ones.

The fee is required under a self-assessment regime via a mechanized stamp adhered to the document or the delivery of a receipt, and the prior deposit does not by itself authorize the occupation of the public road. When several interested parties request the same plot of land, the resolution will consider the proximity of the establishment and the ornamental conditions, and may be resolved by tender. Against the agreement, interested parties may file a contentious-administrative appeal before the Contentious-Administrative Chamber of the High Court of Justice of Asturias within two months from the day following publication, in accordance with Law 29/1998, of July 13.

The modification directly affects cafeterias, bars, cider houses, and restaurants in the council, which must adjust their applications and self-assessments to the new rates and the limits of surface area and ornamentation. The annex of the ordinance also fixes the category of each road, with sixteen streets and squares in the first category —including Mayor, Uría, Díaz Penedela, La Fuente, and the squares Mayor, Asturias, and Conde Toreno— and fourteen in the second, which determines the final price to be paid by each hospitality establishment.
