Campo de Gibraltar: 30 days to modify the discharge ordinance
Por FactBox Admin

The Mancomunidad de Municipios del Campo de Gibraltar has opened a thirty-day public information period to modify its discharge regulatory ordinance, the rule governing discharges into the public sewage and stormwater drainage networks in the municipalities where the entity has assumed sanitation and purification competencies. The initial approval agreement was adopted by the Junta de Comarca in a session held on September 28, 2026, and is published in the B.O.P. de Cádiz nº 205, of October 23, 2026, with official reference Nº 347.064 and file number 586/2026.
The announcement is issued in compliance with Article 49 of Law 7/1985, of April 2, regulating the Bases of the Local Regime, applicable by virtue of the third paragraph of section 6 of Article 20 of Royal Legislative Decree 2/2004, of March 5, which approves the Recast Text of the Law Regulating Local Treasuries. The regulation in force until now is the Mancomunidad’s discharge Ordinance published in the B.O.P. de Cádiz nº 270, of November 21, 2002, which the regional entity itself identifies as the general application rule in the municipal terms where it carries out sanitation.
A hearing process with effects on industries and users
The modification directly affects the industrial fabric of the region and the non-domestic users of the regional wastewater sanitation and purification service. The discharge ordinance is the rule that sets the conditions for evacuation to public networks, and its update is linked to the discharge authorization that businesses and industries must keep up to date.
In the service’s fiscal ordinance published in the B.O.P. de Cádiz nº 160, of August 20, 2026, the Mancomunidad already provides for a 5% surcharge on the variable fee blocks for non-domestic users who do not have an updated discharge authorization in accordance with that ordinance. The material management of the service corresponds to the public-capital company Agua y Residuos del Campo de Gibraltar (ARCGISA), an instrumental entity of the Mancomunidad.
How and where to submit allegations
The period is thirty days and is counted from the day following the publication of the announcement in the Official Provincial Gazette, that is, from October 24, 2026. During this period, interested parties may:
- Examine the file at the Secretaría General of the Mancomunidad.
- Consult the full text of the modification on the entity’s Transparency Portal, on the corporate website https://www.mancomunidadcg.es/.
- Review the text on the Notice Board of the Mancomunidad’s electronic headquarters.
- Submit claims and suggestions within the indicated period.
What happens if there are no claims
Once the public exhibition period has ended, the Junta de Comarca (Regional Board) will adopt the appropriate final agreement, resolving any claims submitted. However, if none are filed, the modification agreement will be understood as definitively adopted without the need for a new plenary agreement by the Junta de Comarca.
In any case, the final agreement—including the initial one automatically elevated to that category—and the full text of the modified ordinance must be published in the B.O.P. de Cádiz, and the regulation will not enter into force until the periods provided for in articles 65.2 and 67.1 of Law 7/1985, of April 2, have elapsed and said publication has taken place. The announcement is signed by the president of the entity, Susana Rosa Pérez Custodio, dated October 8, 2026.
The same bulletin contains other public information from the Mancomunidad, in this case relating to the ordinance on the patrimonial provision of the water supply service in the La Alcaidesa urbanization, with file 585/2026 and reference No. 347.053, processed in the same session on September 28.
The revision of the discharge ordinance comes at a time when the regional sanitation and purification service conditions the activity of industries, businesses, and large users in the region. For them, the text resulting from this process will establish the conditions for discharge into public networks and the requirement to keep the discharge authorization up to date, a requirement that the Mancomunidad already links to surcharges on the service bill.
