Campo de Criptana revisa de oficio una transferencia de crédito municipal

The Municipal Plenary of Campo de Criptana agreed on October 23, 2026, to initiate an ex officio review of the plenary agreement of 07/30/2026, which initially approved credit transfer 13/2026, considering that it was adopted by a manifestly incompetent body. The agreement, passed by an absolute majority of the legal number of members of the Corporation, is published in the Official Gazette of the Province of Ciudad Real number 211, dated November 2, 2026, in announcement 3526 (CVE sV5sCSFiF7gAuLhtEoBB). The procedure directly affects the Local Police staff, who have been declared interested parties.

The act now being questioned is the agreement of the Plenary of July 30, 2026, by which the credit modification file 13/2026, file 3579/2026, was initially approved under the modality of credit transfer. That agreement became final as no claims were filed and was published in the Official Gazette of the Province of Ciudad Real number 165, dated August 28, 2026 (announcement 2760), in application of article 169 of the consolidated text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5.

The operation moved 26,091.35 euros toward application 2026 01 13200 15100 01, “Security and Public Order. Gratifications,” charged to three personnel applications within the same area: group C1 salaries (-10,300.00 euros), destination supplement (-3,600.00 euros), and specific supplement (-12,191.35 euros).

An ex officio procedure

The plenary agreement was adopted in an extraordinary session and consists of eight points. The first declares the lack of active legitimacy of the Popular Municipal Group to urge the ex officio review, as they abstained from the vote. The second opens the procedure ex officio to review, due to the manifest incompetence of the body, the July agreement regarding the credit modification.

The announcement does not specify which body was competent to approve the transfer nor the material reasons for the incompetence; it limits itself to stating that the review is directed against the agreement of 07/30/2026.

Notification, allegations, and mandatory report

The plenary details the processing in the remaining six points, which outline a specific calendar for file 5092/2026:

  • Notify the interested parties, the Local Police staff, of the start of the procedure, who will have 10 days to present any allegations and suggestions they deem necessary.
  • Publish the announcement in the BOP for general knowledge.
  • Forward the file to the municipal services so they may report on the allegations presented.
  • Remit the file to the Secretariat, following the technical report, for the issuance of the proposal-report.
  • Submit the proposal-report to the Plenary, which will adopt it and request a mandatory opinion from the Consultative Council of Castilla-La Mancha.
  • Suspend the maximum legal period for resolution during the time elapsed between the request for the opinion and its receipt.
  • Submit the opinion to the Plenary again once received, given its mandatory and binding nature.

Affected Parties and Publication

The affected parties are the members of the municipality’s Local Police staff, whose bonuses depended on the transferred credit. The announcement recognizes them as interested parties and opens a hearing process that influences the direction of the proposal-report and, ultimately, the opinion of the Consultative Council of Castilla-La Mancha.

The agreement is published at the request of the City Council of Campo de Criptana, signed by its mayor, Santiago Lázaro López, on October 29, 2026, four days before its appearance in the provincial bulletin.

Implications for the Municipality

The ex officio review opens the door to annulling a budgetary agreement that had already been finalized and published, which would force the restructuring of the funding for the Local Police bonuses or the search for alternative budgetary coverage. Furthermore, the file is subject to a mandatory and binding regional opinion, meaning the final decision does not depend solely on the Plenary of Campo de Criptana.
