Por FactBox Admin

The Plenary Session of the Calahorra City Council, in its session held on November 3, 2026, agreed to definitively approve Specific Modification number 19 of the Municipal General Plan of Calahorra, aimed at recovering the original quality determinations of the Execution Unit U.E.-2 Conservas Serrano (Plaza Roma). The agreement, which exhausts the administrative route, is published in the Official Gazette of La Rioja number 214, of Thursday, November 5, 2026, section III, with the official reference BOR-A-20261105-III–4167.
The resolution is inserted in section III of the gazette, dedicated to other provisions and acts, and is internally identified in the summary with number III.4167 and file 202611040125387. The text is signed in Calahorra, on the same date as the agreement, by the Mayor-President, Mónica Mercedes Arceiz Martínez, and consists of two pages of the gazette, between 18822 and 18823.
What changes in the special ordinance
The modification acts upon article 238 bis of the Plaza Roma Special Ordinance, referring to the area of the former U.E.-2 Conservas Serrano and designated by the acronym OEPR. The approved content is specified in two determinations:
- The continuation of the plaza’s eaves toward Pintor Pradilla Street is permitted.
- These eaves will imply a greater building height on said street.
- The treatment of the height shall be agreed upon with the Calahorra City Council.
The approved document remains available for public consultation in the current planning section of the municipal transparency portal, within the City Council’s environmental and urban planning information.
Promotion and drafting of the document
The urban initiative was promoted by González Sáenz Promociones, S.L., the company listed as the promoter in the plenary agreement. The technical drafting of the document was carried out by the architect Eduardo Cáseda García, as expressly stated in the published text.
With the definitive approval, the processing of the modification is closed and the original quality determinations of the execution unit are recovered, a step that directly affects the planned development in the surroundings of Plaza Roma. The plenary agreement is limited, in regulatory terms, to the modification of the special ordinance and the enabling of the new eaves and height solution on the Pintor Pradilla Street front.
Deadlines and means of appeal
The agreement exhausts the administrative route; therefore, the gazette details the available appeals and their deadlines, counted from the day following the publication:
- Optional appeal for reversal (recurso potestativo de reposición), limited to the administrative act of final approval in its formal elements, within a period of one month, pursuant to Article 123 of Law 39/2015, of October 1.
- Direct contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Logroño, within a period of two months, according to Article 46 of Law 29/1998, of July 13.
- If the content of the act is challenged as an administrative provision of a general nature, only a contentious-administrative appeal may be filed within two months before the Contentious-Administrative Chamber of the High Court of Justice of La Rioja, pursuant to Articles 10 and 46 of the same procedural regulation.
Publication in the official bulletin is the act that triggers these deadlines; therefore, any interested party or person affected by the planning has two months from the day following November 5, 2026, to seek recourse through the contentious-administrative jurisdiction. For the residents and owners in the vicinity of Plaza Roma, the final approval clears the uncertainty regarding the building conditions of the area and enables the development of the unit in accordance with the recovered original determinations.
